SUBJECT: EXEMPTION FROM PART LOT CONTROL - CARHOLME INVESTMENTS
(SOUTH BOWMANVILLE INDUSTRIAL PARR)
PART OF LOT 8, B. F. CONCESSION, FORMERLY TOWN OF BOWMANVILLE
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-15-90 be received;
2 . THAT the request submitted by Carholme Investments Limited for
removal of Part Lot Control on Blocks 9 & 14 on Plan 10M 831, be
approved;
3 . THAT the attached by-law be approved and forwarded to the Regional
Municipality of Durham pursuant to Section 49 (7) of the Planning
Act; and
4 . THAT Carholme Investments Limited be so advised.
1. LOCATION
1 . 1 The Bowmanville South Industrial Park is located on the south side
of Highway No. 401 west of Port Darlington Road fronting on Lake
Road, within the former Town of Bowmanville.
2 . BACKGROUND
2 . 1 Staff received a request from Ms. Alina Bridgeman of Inducon
Consultants on behalf of Carholme Investments Ltd. for removal of
Part Lot Control in respect of Blocks 9 and 14 on Plan 10M 831.

2 .2 The purpose for removal of Part Lot Control is to permit the
creation of three (3) additional industrial blocks . This process
will enable each to be developed for potential users who do not
require as large a parcel as originally draft approved.
2 . 3 These blocks are located in a registered plan of subdivision and
there is an existing subdivision agreement in place to cover the
Town's financial interests . Staff would confirm that blocks 9 and
14 were originally serviced to complement the creation of
additional blocks .
3 . COMMENTS
3 . 1 Staff has no objection to the approval of the by-law exempting the
subject lands from Part Lot Control.
3 .2 Attached hereto is a by-law to exempt the subject lands from
Section 49 (5) of the Planning Act pursuant to the provisions of
Section 49 (7 ) of said Act. This by-law requires approval of
Council and the Regional Municipality of Durham.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 89-
being a By-law to designate a certain portion of a registered plan
as not being subject to Part Lot Control.
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it desireable to exempt from Part Lot Control, Blocks 9 and
14 on Plan 10M 831 registered at the Land Registry Office for the
Land Registry Division of Newcastle (No. 10) on November 7, 1989.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation
of the Town of Newcastle enacts as follows:
1. THAT Subsection (5) of Section 49 of the Planning Act shall
not apply to those lands described in Paragraph 2 within this By-
law.
2. This By-law shall come into effect upon being approved by the
Regional Municipality and thereafter Subsection (5) of Section 49
shall cease to apply to the following lands:
Blocks 9 & 14 on Plan 10M 831.
BY-LAW read a first time this day of 1990.
BY-LAW read a second time this day of 1990.
BY-LAW read a third time and finally passed this day of
1990.
