SUBJECT: EXEMPTION FROM PART LOT CONTROL - TRIBUTE CASTLE DEVELOPMENT
(COURTICE HEIGHTS SOUTH)
PART LOT 31, CONCESSION 2, FORMERLY TOWNSHIP OF DARLINGTON
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD- 16 -90 be received; and
2 . THAT the request submitted by Tribute Castle Developments Inc . for
removal of Part Lot Control on lots 1 to 24, 46 to 49, 68 to 81,
86 to 99, 104 to 113 all inclusive on Plan 10M 820 and Lots 22 to
41 all inclusive on Plan 10M 821, be approved;
3 . THAT the attached by-law be approved and forwarded to the Regional
Municipality of Durham pursuant to Section 49 (7) of the Planning
Act; and
4 . THAT Tribute Castle Development be so advised.
1. LOCATION
1. 1 The "Courtice Heights South" subdivision is located between Trulls
Road and Prestonvale Road, south of Highway No. 2 .
1.2 The lots within Plan 10M 820 are located on the following street
frontages .
Lots 1 to 24 north and south sides of Stuart Road
Lots 46 to 49 Hillhurst Crescent, north and south sides .
Lots 68 to 81 Hillhurst Crescent, north and south sides .
Lots 86 to 99 Hillhurst Crescent, north and south sides.
Lots 104 to 113 Hillhurst Crescent, north and south sides.

1.2 The lots within Plan 10M 821 being lots 22 to 41 are located on the
east and west sides of Yorkville Drive.
2 . BACKGROUND
2 . 1 Staff received a request from Lucy Stocco, on behalf of Tribute
Castle Developments Inc . for removal of Part Lot Control in respect
of Lots 1 to 24, 46 to 49, 68 to 81, 86 to 99 and 104 to 113, all
inclusive on Plan 10M 820 and lots 22 to 41 all inclusive on Plan
10M 821.
2 .2 When Plans 10M 820 and 10M 821 were registered, Courtice Heights
South registered the blocks as draft APPROVED for street townhouses
as individual lots .
2 . 3 Tribute Castle Developments Inc. , the builder, advised staff that
as a result of the siting of the townhouses, a small portion of the
foundation wall of each unit encroaches onto the adjacent lot. The
foundation encroachments varies from approximately 0.01 to 0 .20
metres . Accordingly Tribute Castle Developments Inc. wishes to
convey the minor encroachments of the foundation wall to the
individual homeowners .
2.4 The lots are located in a registered plan of subdivision and there
is an existing subdivision agreement in place to cover the Town's
financial interests .
3 . COMMENTS
3. 1 Staff has no objection to the approval of the by-law exempting the
subject lands from Part Lot Control.
3.2 Attached hereto is a by-law to exempt the subject lands from
Section 49 (5) of the Planning Act pursuant to the provisions of
Section 49 (7) of said Act. This by-law requires approval of
Council and the Regional Municipality of Durham. . . . 3

3.3 Once all the dwellings are erected and conveyed, Staff will bring
forth a by-law repealing this by-law so that Part Lot Control will
be restored on the subject property in accordance with the Planning
Act.

DN: TRIBUTE
THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 90-
being a By-law to designate a certain portion of a registered plan
as not being subject to Part Lot Control.
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it desireable to exempt from Part Lot Control, Lots 1 to 24,
46 to 49, 68 to 81, 86 to 99, 104 to 113 all inclusive on Plan 10M
820 registered at the Land Registry Office for the Land Registry
Division of Newcastle (No. 10) on January 9, 1989 and Lots 22 to
41 all inclusive on Plan 10M 821 registered at the Land Registry
Office for the Land Registry Division of Newcastle (No.10) on
January 9, 1989.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation
of the Town of Newcastle enacts as follows:
1. THAT Subsection (5) of Section 49 of the Planning Act shall
not apply to those lands described in Paragraph 2 within this By-
law.
2. This By-law shall come into effect upon being approved by the
Regional Municipality and thereafter Subsection (5) of Section 49
shall cease to apply to the following lands:
1) Lots 1 to 24, 46 to 49, 68 to 81, 86 to 99, 104 to 113 all
inclusive on Plan 10M 820.
2) Lots 22 to 41, inclusive on Plan 10M 821.
BY-LAW read a first time this day of 1990.
BY-LAW read a second time this day of 1990.
BY-LAW read a third time and finally passed this day of
1990.
