RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD- 20 -90 be received for information.
1. BACKGROUND
1. 1 Council at their meeting held on December 11, 1989 in consideration
of Mr. O'Neill's presentation, endorsed a resolution that Mr.
O'Neill's concerns be referred to the Planning Department for a
report back to the General Purpose and Administration Committee in
early January 1990 .
2 . LOCATION
2 . 1 Mr. O'Neill's property (see attached sketch) is located within part
of lot 10 Concession 2, former Township of Clarke - hamlet of
Newtonville. The entire holdings is approximately 85 acres
(34 . 39 ha) in size, of which five (5) acres at the most southerly
end is located within the limits of the Hamlet of Newtonville.

3 . STAFF COMMENTS
3 . 1 Application No. LD 780/89 was submitted for the Land Division
Committee's consideration at their meeting held on December 4,
1989 . Mr. O'Neill wished to sever that portion of his lands,
approximately 2 ha (5 acres) located within the limits of the
hamlet.
3 .2 Staff, in providing comments for the Land Division Committee's
consideration, noted that the Town of Newcastle Official Plan
requires that all new development in Newtonville is to proceed on
the basis of municipal water and private waste disposal system.
Once the capacity of the municipal water system has been achieved,
no further development will be permitted. Correspondence to the
Town from the Regional Works Department, dated April 24, 1989 noted
that the O'Neill's applied for six (6) water connections but were
on a waiting list for said services .
3 . 3 In consideration of the comments as submitted to the Land Division
Committee, staff would not support the application.
3 .4 Staff would confirm that the comments of the Region of Durham
Planning Department were similar to those provided by Town staff.
3 .5 Application LD 780/89 was tabled for a period of one year by the
Land Division Committee to permit Mr. O'Neill the opportunity to
address the concerns raised.
3 .6 Within the Newtonville Hamlet Development Plan prepared in 1979 by
Town staff, (see attached plan) , Mr. O'Neill's lands were partially
included within the hamlet limits, and designated "area subject to
development restrictions" . This was the status of Mr. O'Neill's
land till the end of 1987 .

3 .7 In 1988, Regional Staff requested clarification of Town council as
to the potential limits by which the Town would foresee expansion
of Newtonville resulting from the provision of municipal water.
While review of the Newtonville Plan was in progress, Regional
Staff invited various owners in Newtonville to attend a meeting to
discuss the possibility of inclusion of their lands within the
hamlet and possible development on municipal water supply.
3 .8 It is staff 's understanding Mr. O'Neill did not attend the
scheduled meeting back in December 1988 . As a result, the Region
did not allocate water supply to his land. Mr. O'Neill attended
Council's meeting on December 11, 1989 and stated that he did not
attend the Region's meeting because his discussions with Town
Staff, in 1987 , was that his land is not included in the Hamlet.
As noted in paragraph 3 . 6 of this report, the southerly portion of
Mr. O'Neill's land is within the "area subject to development
restriction" which basically could be interpreted by Mr. O'Neill
as "outside the hamlet limit" .
3 . 9 The information provided by Staff to Mr. O'Neill in 1987 or earlier
was the correct information at that time. It appears obvious that
when Mr. O'Neill was invited by the Region to attend a meeting to
discuss possible water supply to his property, that there is a
possibility that part of his land could be developable on water
supply. Town Staff cannot be held responsible if Mr. O'Neill did
not pursue the matter to protect his own interest.
3 . 10 The Newtonville Hamlet Plan as approved by the Region now
identifies the southerly five (5) acres of Mr. O'Neill's property
within the hamlet limit. However, the Hamlet Plan policies
prohibit development until water supply is available. It is
Staff's understanding that Mr. O'Neill is presently on the Region's
waiting list for water supply. Development of his lands could be
reconsidered at such time when the Region advises that water supply
will be allocated to his land.

WHEREAS Mr. O'Neill applied to the Durham Land Division Committee for severance of a 5 acre
parcel in the Hamlet of Newtonville;
WHEREAS the Land Division Committee tabled his application to allow him to resolve the concerns
raised by the Town of Newcastle;
WHEREAS Mr. O'Neill now indicated that he has no intention to develop the 5 acre property until
municipal water supply is available to his property;
WHEREAS Mr. O'Neill proposed severance follows the natural hamlet boundary of the Hamlet of
Newtonville and is therefore considered as a logical severance;
NOW THEREFORE the Council of the Town of Newcastle resolves as follows:
THAT the Durham Region Land Division Committee be advised that the Town of Newcastle
has no objection to LD 780/89, subject to the applicant satisfying the requirement, financial and
otherwise, of the Town of Newcastle.
