By-Law # MEETING: General Purpose and Administration Committee DATE: MONDAY, JANUARY 23, 1989 REPORT #: PD-15-89 FILE #: DEV 88-67 SECT: REMOVAL OF "HOLDING" SYMBOL TO IMPLEMENT PLAN OF SUBDIVISION PART OF LOT 35, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON APPLICANT: REDESCO INC. FILE: DEV 88-67 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-15-89 be received; and 2. THAT the By-law amendment attached hereto to remove the (H) Holding Symbol from said lands within Part of Lot 35, Concession 2, former Township of Darlington, be approved. 1. BACKGROUND 1.1 On June 3, 1988 the Planning Department received an application submitted by Redesco Inc. requesting the removal of the " (H) Holding" symbol from lands in Part of Lot 35, Concession 2, former Township of Darlington. Staff would note the subject lands through Plan of Subdivision 18T 87019 has received the appropriate draft plan approval, and subsequently thereto the submission and completion of a subdivision agreement between the Owner and the Town. . . .2 /l REPORT 00. : PD-15-89 PAGE 2 ------------------------------------------------------------------------------- 1.2 The "Holding" symbol shall be removed upon council being satisfied that the ooeo to be permitted will be adequately serviced, the lands to be used have adequate access, prior ooeo of the land will not prevent the use of the land for the purposes intended by the By-law, that the Iam3a and proposed uses will be adequately protected from any obvoinaI or manmade hazards and conditions associated with the lands, and that the agreements in respect of such matters and the associated financial requirements, where required, have been executed with the Town of Newcastle and/or the Regional municipality of Durham. 1.3 Staff are now in a position to recommend that the o (B) Holding" amnboI be Iifted, inasmuch as the conditions of draft approval requested as conditions of the Town's approval, have been fulfilled through the Development Agreement. 1.4 Staff have no objection to the application and would respectfully recommend that the attached by-law be forwarded to Council for approval. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule 113" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Holding - Urban Residential Type One ((H)R1)" to "Urban Residential Type One (Rl)" Zone as shown on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 35 of the Planning Act.
