By-Law # MEETING: General Purpose and Administration Committee DATE: Monday, January 9, 1989 REPORT #: PD-6-89 FILE #: 18T-87002 SUB,1ECT: EXEMPTION FROM PART LOT CONTROL - SUBDIVISION 18T-87002 PENWEST DEVELOPMENT (PHASE I - 1OM-818) PART LOT 301 CONCESSION 1, CLARKE RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-6-89 be received; and 2. THAT the request submitted by G.M. Sernas & Associates on behalf of Penwest Development Corporation Limited for removal of Part Lot Control on Lots 18 to 26 and Lots 27 to 33 inclusive on Plan 1OM-818, be approved; and 3. THAT the attached by-law be approved and forwarded to the Regional Municipality of Durham pursuant to Section 49, Subsection (7) of the Planning Act; and 4. THAT G.M. Sernas & Associates be so advised. 1. BACKGROUND 1.1 Staff received a request from Mr. T.T. Edwards of Sernas and Associates on behalf of Penwest Development Corporation for removal of Part Lot Control in respect of Lots 18 to 26 and Lots 27 to 33, inclusive on Plan 1OM-818. . . .2 REPORT N0. : PD-5-99 PAGE 2 _______________________________________________________________________________ 1.2 The purpose for removal of Pact Lot Control is to permit the cuuaLcuntiou of semi-detached/link dwelling units on the lots in question which have been zoned, and approved for semi-detached and/or linked dwellings. This process will enable these lots to be divided and resurveyed after the dwelling foundations are in place. Otherwise it would be impossible to pinpoint the common wall and fix the lot line at the time of registration of the subdivision. 1.3 These lots are located in a registered plan of subdivision and there is an existing subdivision agreement in place to cover the Town's financial interest, including the payment of lot levy. 3. COMMENTS 2.1 Staff have reviewed the requests and have no objection to the approval of the by-law exempting the subject lands from Dnct Lot Control. 2.2 In that regard, attached herewith is a by-law which requires approval of Council and the Regional Municipality of Durham which would exempt the subject lands from Section 49(5) of the Planning Act pursuant to the provisions of Section 49(7) of said Act. 2.3 once all the dwellings are erected and conveyed, Staff will bring forth a by-law repealing this by-law so that Part Lot Control will be restored on the subject property in accordance with the Planning Act. N m SUNSET 8LV0. ^' x M A C D 0 N A L 0 C A R T I E R F R E E W A Y DN: PT/LT °Y THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 89- being a By-law to designate a certain portion of a registered plan as not being subject to Part Lot Control. WHEREAS the Council of the Corporation of the Town of Newcastle deems it desirable to exempt from Part Lot Control, Lots 18 to 26 and 27 to 33 Inclusive of Plan 10M-818, registered at the Land Registry Office for the Land Registry Division of Newcastle (No. 10) on December 1st, 1988. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. THAT Subsection (5) of Section 49 of the Planning Act shall not apply to those lands described in Schedule "A" attached to this By-law. 2. This By-law shall come into effect upon being approved by the Regional Municipality of Durham and thereafter Subsection (5) of Section 49 shall cease to apply to the lands described in Schedule "A" attached hereto. 3. Schedule "A" attached hereto shall form part of this By-law. BY-LAW read a first time this day of 1989 BY-LAW read a second time this day of 1989 BY-LAW read a third time and finally passed this day of 1989.
