SUBJECT: REZONING APPLICATION - KENNETH & RUTH WRIGHT
PART LOT 23, B.F. CONCESSION, FORMER TOWNSHIP OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-45-89 be received; and
2. THAT Application to amend the Town of Newcastle Comprehensive Zoning
By-law 84-63, as amended, submitted by Kenneth and Ruth Wright, be
referred back to Staff for further processing and the preparation of a
subsequent report upon receipt of all outstanding comments; and
3. THAT a copy of Council's decision be forwarded to the interested
parties attached hereto.
1. BACKGROUND:
In October, 1988, the Town of Newcastle Planning and Development
Department received an application to amend the Town of Newcastle
Comprehensive Zoning By-law 84-63, as amended, as well as to enter into
Site Plan Agreement. The rezoning would permit the outside storage of
trucks and construction equipment while retaining the single family
dwelling on site. Staff note the application is subject to Site Plan
Approval should the zoning be amended to allow the proposed use.

1.2 The subject site is located in Part Lot 23' Broken Front Concession,
former Township of Darlington. It is no the south side of Baseline
Road, immediateIl, west of Rundle Road and north of Canadian Pacific
Railway line. Adjacent land ooeo include industrial to the west,
vacant land to the north, the Oshawa Pigeon Club to the smnt and the
Canadian Pacific right-of-way to the south.
2. PUBLIC NOTICE:
2.1 Staff would note for the Cmmittee`o information that, pursuant to
Council's resolution of JoIlr 36' 1982 and the requirements of the
Planning Act, the appropriate oiguage acknowledging the application was
installed on the subject lands and, ouzzuoudiog property owners were
advised of the proposal.
3. OFFICIAL PLAN CONFORMITY:
3.1 Within the Durham Regional Official Plan Staff have determined the
subject property to be designated Mo'uz Open Space. Section 24 of the
Planning Act states that no by-law shall be passed for any purpose that
does not conform with the Official Plan. The proposal does not appear
to conform to the Official Plan.
4. CIRCULATED AGENCIES:
4.1 To date comments remain outstanding from four (4) of the circulated
agencies. These include Regional Planning, Regional Public Works,
Central Lake Ontario Conservation Authority and Canadian Pacific
Railway. Of the agencies which have commented to date all have replied
with no objection to the proposal.

4,2 Town of Newcastle Public Works Department have commented that various
conditions will require to be fulfilled prior to the rezoning and Site
Plan being approved. This includes revisions to the Site Plan in terms
of drainage and entrance requirements. As well the applicant will be
responsible for external works as required as a result of this proposal.
5. STAFF COMMENTS:
5.1 V0zeu, this application was received Staff informed the applicant that an
Official Plan Amendment would be required. The applicant and their
solicitor later informed Tmvo Staff that Region did not want to comment
on official Plan conformity until the Rezoning was circulated. To date
no written comments have been received from the Region's Staff as to
their comment on the issue of Official Plan conformity.
6. RECOMMENDATION:
6.1 As the purpose of this report is to address the requirement of Public
Meeting as under the Planning Act and in consideration of the comments
outstanding, and the issue of official Plan conformity, Staff
recommend the application be referred back to 8tott for further
processing.
