By-Law # MEETING: General Purpose and Administration Committee DATE: Monday February 20, 1989 REPORT #: PD-44-89 FILE #: DEV 88-127 SUBJECT: REZONING APPLICATION - ROY NICHOLS MOTORS PART LOT 29, CONCESSION 2, DARLINGTON DEV 88-127 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-44-89 be received; and 2. THAT the application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amemded, submitted by Roy Nichols Motors, be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3. THAT a copy of Council's decision be forwarded to the interested parties indicated hereto. 1. BACKGROUND: 1.1 In November, 1988, the Town of Newcastle Planning and Development Department received an application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, as well as the existing site plan. The application was submitted by Roy Nichols Motors and proposed to rezone a 1110 m2 parcel to be used for automobile display in conjunction with the lands to the east. .. .2 REPORT NO. : PD-44-89 PAGE 2 ------------------------------------------------------------------------------- 1.2 The subject property is located on the aVotb side of Highway # 2, west of Cburtice Road. It is at the western limit of the Roy 0ioboIo Motors Site, and is presently being used for automobile display purposes. 3. PUBLIC MEETING 2.1 Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate oiguage acknowledging the application was installed on the subject lands and, oozz000diug property owners were advised of the application. 3. OFFICIAL PLAN CONFORMITY 3.1 Within the Regional Official Plan the subject lands are designated "Residential" within a "Major Urban Area". Section 8.3.3.2 of the Durham Regional Official Plan allows the area municipalities to recognize existing Special Purpose Commercial oaea not designated on Map nA». The Town's 0fffioiaI Plan and Zoning By-law do recognize the existing use, therefore the application would appear to conform. 3.2 Within the Town of Newcastle Official 9Iau (Coortice Urban Area) , the subject property is designated Special Purpose Commercial. However, the CVurtice South Neighbourhood Plan only recognizes the existing limits of the automobile dealership. Therefore, a house keeping change will be required of the 0eigblx)ozbood Plan in order to bring it into conformity with the Town official Plan. 4. CIRCULATED AGENCIES 4.1 To date omumeuta remain outstanding from two (2) of the circulated agencies: The Durham Regional Planning Department and the Durham Regional Public Works Department. Of the agencies which have commented the Regional Health Department noted no objection. The Town of Newcastle Public Works Department and the Staff of the Ministry of Transportation both noted no objection in principle to the application. REPORT 0O. : PD-44-89 PAGE 3 _______________________________________________________________________________ 4.2 However, both Public Works Department Staff and Ministry Staff have noted concerns with drainage on the eastern half of the dealership. Runoff from the site is spilling onto Highway # 2 and creating sheet flow across the pavement from south and north. The drainage concerns have been passed on to the applicant, to allow his engineer to address the situation. 5. CONCLUSION: 5.1 As noted above, there has been no objection to the application to date. The proposal would appear to comply with the provisions of both the Durham Regional official Plan and the Town of 0emvoaotIe Official Plan. 5.2 As the purpose of this report is for Public Meeting as required under the Planning Act, Staff recommend that the report be referred back to Staff until such time as all outstanding comments have been received and the above noted comments addressed.
