RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-42-89 be received; and
2. THAT the application to amend the Town of Newcastle Comprehensive Zoning
By-law 84-63, as amended, submitted by G.M. Sernas & Associates Ltd. on
behalf of 689581 Ontario Limited be referred back to Staff for further
processing and the preparation of a subsequent report upon receipt of all
outstanding comments; and
3. THAT a copy of Council's decision be forwarded to the parties attached
hereto.
1. BACKGROUND:
1.1 On October 21, 1988 the Town of Newcastle Planning and Development received
an application to amend the Town of Newcastle Comprehensive Zoning By-law
84-63, as amended. The application was filed by G.M. Sernas and Associated
Ltd. on behalf of 689581 Ontario Limited. The rezoning would permit the
development of 18.93 ha (46.78 acre) parcel of land through Plan of
Subdivision.

1.2 The subject lands are located in Pact Lot 29, Concession %r of the
former Township of Darlington, more specifically south of Highway No.
2 and immediately west of Couctico Road (Regional Road 34) . The
surrounding land ooea include residential to the north; Boy 0inboIo
Car dealership to the north and east; three (2) residential dwellings
to the east on the west aide of Courtice Road, and vacant land to the
east aide of the road; vacant land to the south and west.
1.3 The rezoning proposal, if approved, would allow the development of 102
single family dwelling lots; 62 semi-detached dwelling lots (I24 semi-
detached dwelling units) ; 97 units as part of a Medium Density Block;
and blocks for part of the school and parkland.
2. PUBLIC NOTICE:
2.1 Staff would note for Committee's consideration that, pursuant to
Council's resolution of July 26' 1982 and the requirements of the
Planning Act, the appropriate oiguage acknowledging the application
was installed on the subject lands ood^ ooccooudiog property owners
were advised of the proposal.
3. OFFICIAL PLAN CONFORMITY:
3.1 Within both the Durham Regional Official Plan and the Town of
Newcastle Official Plan the subject property is designated
"Residential" . The predominant one of said land shall be for housing
purposes in accordance with the relevant policies of the official
Plan. The proposed rezoning would appear to conform to the land use
designation of both plans.
3.2 The Courtioe South Neighbourhood Plan also designates the subject
property as "Residential" and it provides detail policy guidelines to
further assist in determining the conformity of said application.

3.3 The subject application is located in Neighbourhood 12C/ of Schedule
6-1 of the Tmvo of Newcastle Official Plan ([bnctice Urban Area) . The
population target for this neighbourhood has been established at 2500
people. In order to attempt to achieve this upper limit, development
may take place at a maximum of 30 units per net residential hectare,
based on the size of the neighbourhood.
3.4 The subject application pzoFmaea an overall density of 26.35 units
per net residential hectare. The density of the proposed Medium
Density Block is 39.87 units. The application would appear to exceed
the maximum density permitted.
4. AGENCY COMMENTS:
4.1 The application submitted by G.M. Sezoaa and Associated Ltd. for a
proposed rezoning and related revised plan of subdivision have been
circulated to a omnbez of agencies. The following provides a summary
of tbe comments relating to this proposal.
4.2 The Town of Newcastle Fire Department has expressed some concern in
terms of the potential increase in residential units vvitblo the
Conctine Area. The Public School Board has commented that this
proposal will increase, by 100, the number of students at Courtioe
North and South Public 8cboVIo. Therefore, they would require a
sidewalk be constructed along Courtioe Road to 0aab Road for
pedestrian traffic. The Ministry of Transportation has requested that
permits be obtained for all buildings located within 600 feet of the
centre point of the intersection of Highway No. 2 and Cooctioe Road.
4.3 The Separate School 8oazd and the Ministry of Natural Reonocmeo have
expressed no concern with respect to the applications. However,
Regional Public Works Department, Regional Planning Department,
Central Lake Ontario Conservation Authority, Town of Newcastle Public
Works Department, and Town of Newcastle Community Services Department
have not yet commented on the application.

5. STAFF COMMENTS:
5.1 In reviewing the proposal, Staff note the plan does not conform to
Regional design policies with regards to reverse frontages on Regional
Road 34. Staff also note that u second access from Highway 0n. 2 to
the plan will be required. This should be provided in the vicinity of
the cul-de-sac at the western boundary of the property, in conformity
with the Courtioe South Neighbourhood DIoo. The proposal should be
further revised to reflect a maximum of 30 units per net residential
hectare.
5.2 Staff further note that a traffic noise impact analysis will be
required in order to properly evaluate this application. The analysis
should reflect the mature state of development in the Couctioe area, as
designated in the Town of Newcastle official Plan. Also the applicant
will be required to undertake n well monitoring program consistent with
Regional policies.
5.3 Staff note a few enquires have been made with respect to the subject
applications and ooucezua raised. In addition a letter of objection
has been received as well as a petition signed by nine (9) residents
objecting to the proposal. Their main objection is with the proposed
Medium Density Block of the application. Other oouoeruo include
potential for well interference and restrictions for possible future
development of adjacent lands.
O. RECOMMENDATION:
In consideration of the number of comments which remain outstanding,
the issues and nouoecua which have been raised, and the fact this
report is for a Public Meeting as required by the Planning Act, Staff
raoonuneud that the application be referred until such time as all
outstanding comments are received and the Plan of Subdivision has been

revised to deal with the above concerns. At such time Staff will be in
a position to make a final recommendation.
