SUBJECT: EXEMPTION FROM PART LOT CONTROL - SUBDIVISION 18T-76027
COURTICE HEIGHTS DEVELOPMENT (10M-821)
PART LOTS 31 & 32, CONCESSION 2, DARLINGTON
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-36-89 be received; and
2. THAT the request submitted by W.D. Manson on behalf of Courtice Heights
Development for removal of Part Lot Control on Lots 2 to 21 and Lots 42
to 65 inclusive on Plan 1OM-821, be approved; and
3. THAT the attached by-law be approved and forwarded to the Regional
Municipality of Durham pursuant to Section 49, Subsection (7) of the
Planning Act; and
4. THAT W.D. Manson be so advised.
1. BACKGROUND
1.1 Staff received a request from Mr. W.D. Manson on behalf of Courtice Heights
Developments for removal of Part Lot Control in respect of Lots 2 to 21 and
Lots 42 to 65, inclusive on Plan 1OM-821.

1.2 The purpose for removal of Pact Lot Control is to permit the
construction of semi-detached/link dwelling units on the lots in
question which have been zoned, and approved for semi-detached and/or
linked dwellings. This pcuneoo will enable these IVto to be divided
and resurveyed after the dwelling foundations are in place. otherwise
it would be impossible to pinpoint the common wall and fix the lot
line at the time of registration of the subdivision.
1.3 These lots are located in a registered plan of subdivision and there
is an existing subdivision agreement in place to cover the Town's
financial interest, including the payment of lot levy.
3. COMMENTS
2.1 Staff have reviewed the cegoeoto and have no objection to the approval
of the by-law exempting the subject lands from Pact Lot Control.
2.3 In that regard, attached herewith is a by-law which requires approval
of Council and the Regional Municipality of Durham which would exempt
the subject lands from Section 49(5) of the Planning Act pursuant to
the provisions of Section 49(7) of said Act.
2.3 once all the dwellings are erected and conveyed, Staff will bring
forth a by-law repealing this by-law so that Pact Lot Control will be
restored on the subject property in accordance with the Planning Ant.

Courtice Heights Developments
Subdivision 18T76027
On January 9, 1989, the last two phases of the
aforementioned subdivision were registered. J. D. Barnes
plan 85-25-706-17-B was registered as 10M-820 and
J. D. Barnes plan 85-25-706-17-A was registered 1OM-821 .
Since plan 1OM-821 contains semi-detached lots, I would
appreciate your arranging for a Part Lot Control Exemption
By-law to be passed by Council for the following
semi-detached lots:
Plan 1OM-821 Lots 2 to 21 inclusive
Lots 42 to 65 inclusive
Although Lot 1 which fronts on Trull' s Road was shown as
a semi-detached lot on the original OMB plan final
dimensions on the M-plan and the yard requirements of
the Town' s Comprehensive Zoning By-law only permit
the construction of one single family unit on this
corner lot. It is for this reason that Lot 1 is

excluded from this Part Lot Control Exemption request.
Your early consideration of this matter would be
appreciated since the builder is anxious to commence
construction.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 89-
being a By-law to designate a certain portion of a registered plan as not being
subject to Part Lot Control.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
desirable to exempt from Part Lot Control, Lots 2 to 21 and 42 to 65 Inclusive of
Plan 1OM-821, registered at the Land Registry Office for the Land Registry
Division of Newcastle (No. 10) on January 9th, 1989.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follow
1. THAT Subsection (5) of Section 49 of the Planning Act shall not apply to
those lands described in Schedule "A" attached to this By-law.
2. This By-law shall come into effect upon being approved by the Regional
Municipality of Durham and thereafter Subsection (5) of Section 49 shall cease
to apply to the following lands:
Lots 2 to 21, and 42 to 65 Inclusive on Plan 1OM-821
BY-LAW read a first time this day of 1989
BY-LAW read a second time this day of 1989
BY-LAW read a third time and finally passed this day of
1989.
