PART LOT 19, CONCESSION 8, FORMER TOWNSHIP OF DARLINGTON RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-33-89 be received; and 2. THAT the application to amend the Enniskillen Hamlet Plan now being processed as a modification to the Enniskillen Secondary Hamlet Plan, submitted by W. G. Dallas on behalf of Kalee Investments Ltd. to permit the development of 201 lots being phase two of Hilltop Estates, be approved; and 3. THAT the decision of Council and a copy of this report be forwarded to Region of Durham Planning Department; and 4. THAT the applicant be so advised. 1. BACKGROUND: 1.1 On July 4, 1988, committee considered Staff Report PD-146-88 in consideration of an application to amend the development Plan for Enniskillen. The amendment would include a 12.3 hectare parcel to be included in the Hamlet boundaries to permit the development of a 201 lot residential plan of subdivision, being second phase of Hilltop Estates (10M 785) . REPORT 00. : PD-33-89 PAGE 2 _______________________________________________________________________________ 1.2 Committee endorsed Staff recommendation to refer the application back to Staff for a subsequent report pending receipt of outside comments and an Engineering Report. 1.3 In addition, the yYioiatrl' of Agriculture and Food requested the applicant to justify the proposed expansion of tbe Hamlet boundary onto agricultural. lands pursuant to Section 3.14 of the Fmodlauda Guidelines. 3. 8OIR]DNDI0Q IJU0D USES: 2.1 The subject lands are located on the west Side of Old Googog Road, 1/2 kilometre north of Regional Road 3, being Part Lot 19' [booesoioo 8, former Township of Darlington. The existing land oaeo adjacent to the proposed development are: To the north: 26 ha parcel in agricultural production To the west: 12 ha parcel in agricultural production To the east: 12.6 ha parcel in agricultural production To the south: Estate Residential Subdivision - phase one Hilltop Estates. 3. PUBLIC MEETING AND GDI8MI88I00: 3.1 Pozooaot to the requirements of the Planning Act, a public meeting was boId on July 4, 1988 3.2 Mr. Frank Stenger living to the north and east of the subject looda' spoke in opposition to the proposal on the basis of urban type naeo encroaching on agricultural lands. 3.3 Mr. Richard Rowan spoke out in opposition to the proposal, noting that be would like to develop his lands mbinb are located on the northeast quadrant of the hamlet, within the boundary. Mr. Rowan believes his land obooId be considered for development before the subject application is approved. Mr. Rowan has not yet submitted an application to the Town. CIRCULATION COMMENTS: 4.1 In accordance with departmental procedures, the applications were circulated to various agencies and departments for comment. The following is a aunmazl' of comments which have been received. 4.3 The Town of Newcastle Public Works Department offered no objection to the principle of the development, however, noted tabt the particulars of the development would be addressed, when the plan of Subdivision was submitted. 4.3 The Town of Newcastle Fire Department offered no objection noting that the applicant most adhere to the applicable sections of the Ontario Building Code and Ontario Fire Code. 4.4 The Town of Newcastle Community Services Department offered on objection provided the applicant pay to the Town 5% cash-in-lieu of parkland dedication. 4.5 The Health 3eznioeo Department offered no objection, however, the number of lots that are suitable for on-site sewage disposal will be determined when the subdivision proposal is circulated. 4.6 The Central Lake Ontario Conservation Authority offered no objection to the proposal in principle however, suggested that approximately 6 acres of the vaIIeylaod in the northwest corner of the site should be excluded from the area to be designated for residential use. REPORT K0. : PD-33-89 PAGE 4 ------------------------------------------------------------------------------- 4.7 As noted earlier the Ministry of Agriculture and Food had required the applicant to satisfy section 3.14 of the FoodIaud Guidelines. The Ministry had received and reviewed the information provided by the applicants and are satisfied that the criteria of the Foodlamd Guidelines have been met. On November l, 1988, the Ministry withdrew the objections of May 13r I988r for this particular development. 4,8 The following agencies offered no objection to the proposal as filed: Ministry of Natural Resources Ontario Hydro Region of Durham Works Department Northumberland and Newcastle Board of Education Peterborough Victoria Northumberland and Newcastle Buusau Catholic Separate School Board 5 COMMENTS: 5.1 Staff have reviewed the prVyVaeI with respect to the policies in the Durham Regional Official Plan. Section 10.4.12 of the Plan identifies Enniskillen as a Hamlet for growth. The hamlet can develop to a maximum of 200 residential units within the existing hamlet boundary. Staff have identified approximately 132 existing units and units currently under development. There are a probable 41 units that could be developed, 35 units in the northeast quadrant of the hamlet, the remainder as iufilliog. Therefore a total of 27 units can still be developed for this hamlet prior to ceeobiug the 200 unit maximum. 5.2 In considering the alternate location for expansion of the hamlet, the applicant's consultant had noted that the lands adjacent to the boundary to the anotb and east support livestock operations. Development of lands adjacent to such a use would be unfavourable. The lands to the west *noId be difficult to develop because of the nature of terrain. Therefore the most logical for future expansion would be to the oVctb. In addition, the Ministry of Agriculture and Fond offered no objection and thereby Section 3.14 of Fom3lamd Guidelines have been satisfied. 5,4 Pursuant to the requirements of the Durham Regional Official DIau and Town of Newcastle Official gIao an Engineering Study was submitted to the Town for review. The report indicated that one acre lots would be appropriate size for drilled wells and on-site sewage 8ioDoaaI systems. G. RECOMMENDATIONS: 6.1 Given the above noted information, Staff would offer no objection to the proposal and would respectfully recommend that proposal be approved as a modification to the Enniskillen Secondary Hamlet Plan, noting that Section 9 of the Town of Newcastle Official Plan has been approved by Regional Council as of January II, 1989 and is currently under review by the Minister of Municipal Affairs. DeFiliBpio 51 Wolcott Ave., GC&R80R0OGB, Ontario MI[ 4K6 DN: ENNIS MODIFICATION NO. 1 TO THE ENNISKILLEN SECONDARY HAMLET PLAN PURPOSE: The Purpose of the Modification to the Enniskillen Secondary Hamlet Plan is to expand the boundary of the northern limits to permit the development of twenty (20) lots in a Plan of Subdivision. LOCATION: The subject property is located in the Hamlet of Enniskillen along the west side of Old Scugog Road approximately 5 kilometre north from Regional Road # 3 being part Lot 19, Concession 8, former Township of Darlington. BASIS: The modification is the result of an application to the expansion of the Hamlet boundary of Enniskillen, to permit the development of twenty (20) residential lots. Enniskillen is recognized as a Hamlet for Growth would allow for 200 residential units. Section 3.14 of the Foodland Guidelines has been satisfied and the Engineering Study indicated soil and water conditions are suitable for the development of twenty (20) residential lots on private services. ACTUAL HAMLET MODIFICATION: The Enniskillen Secondary Plan is hereby modified as follows: 1. by extending the Hamlet boundary to incorporate the subject lands to be designated as "Residential Expansion" as indicated on Schedule "X" attached. IMPLEMENTATION: That the provisions set forth in the Town of Newcastle Official Plan regarding the implementation of the Official Plan shall apply in the regard to this modification. INTERPRETATION: That the provisions set forth in the Town of Newcastle Official Plan regarding the interpretation of the Official Plan shall apply in the regard to this modification.
