SUBJECT: REZONING APPLICATION - TERRY PRICE
PART LOT 6, CONCESSION 1, FORMER TWP. OF DARLINGTON

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-31-89 be received; and
2. THAT the application submitted by Mr. Terry Price to rezone a .8 hectare
parcel of land to permit the development of a farm produce and garden retail
outlet be referred back to Staff for further processing.
1. BACKGROUND:
1.1 On November 1, 1988, the Planning and Development Department received an
application to amend By-law 84-63 from Terry Price. The application would
seek to rezone 0.8 hectares of a larger 22.6 hectare parcel of land
currently zoned "Agricultural (A-l)" to an appropriate zoning category, to
permit the sale of farm and garden produce.
2. LOCATION:
2.1 The subject lands are located on the south-east corner of Kings Highway No.
2 and Lambs Road being Part Lot 6, Concession 1, former Township of
Darlington.

3. OFFICIAL PLAN CONFORMITY:
3.1 Within the Durham Regional Official Plan the subject site is
designated as "Permanent Agricultural Reserve". Section I1.2.2 states
that the predominant land use shall be for agricultural and
farm-related uses. In addition, Section 11.2.3. states that
agricultural and farm-related ooeo shall include retail stands for
sale of agricultural products produced on the farm unit.
4. PUBLIC NOTICE:
4.1 Pursuant to Council's resolution of July 26' 1982 and the requirements
of the Planning Act, the appropriate oiguage acknowledging the
application was installed on the subject lands.
5. CIRCULATION:
5.1 In accordance with departmental procedures, the application was
circulated to obtain comments from other departments and agencies.
Staff would note the following departments/agencies, in providing
comments, offered no objections to the application as filed:
- Town of Newcastle Fire Department
- Regional BeoItb Department
- Ministry of Agriculture and Fond
- Ministry of Natural De000coea
5.2 The Town of Newcastle Public Works Department offered no objection to
the pcoDnaoI, however, requested that the applicant satisfy their
requirements financial and otherwise.
5.3 The Ministry of Transportation offered no objection, however, requires
the mnneoo to be from Lambs Road and have noted that new buildings will
be required to be a minimum distance of 23m from the centreline of
Highway 0o. 2.
5.4 Staff would note that comments are still outstanding from the following
agencies:
- Regional Planning Department
- Regional Works Department
- Central Lake Ontario Conservation Authority

6. COMMENT:
6.1 Staff had reviewed the application upon submission and was of the
understanding that the applicant proposed an outlet for the retail
sales of produce from his farm as well as other farms. The sale of
goods would also be on a year-round basis, noting that the '&_l"
zoning only permits the sale of produce, seasonally. Given the
information, Dzovided^Staff accepted and circulated the application.
6.2 Through recent discussion with the applicant (January 36/ I989) ' it
would appear that be only proposes to sell the products gcmvo on his
farm unit on a seasonal basis, from June to October. Staff have
requested that the applicant submit this in writing. Nothing has been
received to date.
6.3 This BwDoct is prepared for the purpose of facilitating a Public
Meeting in accordance with the Planning Act requirement. Once Staff
have ascertained exactly what the applicant proposes, Staff will be in
a position to report back to Committee with respect to this
application.
