L1. � Res. # By-Law # MEETING: General Purpose and Administration Committee DATE: MONDAY FEBRUARY 6, 1989 REPORT #: PD-30-89 FILE #: 88-095 D/N, DEV 88-117, 18T-88082 SUBJECT: OFFICIAL PLAN AMENDMENT, REZONING AND SUBDIVISION APPLICATIONS: VELTRI & SON LTD., PART LOT 5 & 6, CONC. 1, FORMER TOWNSHIP OF CLARKE OUR FILE: 88-095 D/N, DEV 88-117, 18T-88082 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-30-89 be received; and 2. THAT the Official Plan Amendment submitted by Veltri and Sons Ltd. to extend the boundary of the Hamlet of Newtonville to implement an 84 lot residential subdivision be DENIED; and 3. THAT the accompanying Rezoning and Subdivision applications be DENIED; and 4. THAT the Region of Durham, the applicant and the applicant's agent be so advised. 1. BACKGROUND 1.1 On October 20, 1988, the Town of Newcastle Planning Department received an application from Veltri and Son Ltd. to rezone a 52.33 ha parcel of land to permit the development of an eighty-four (84) lot residential subdivision. 2. . . E202 REPORT N0. : pD-30-84 PAGE 2 _______________________________________________________________________________ 1.2 On October 31, 1988, the Town of Kkev000tIe received notice from the Region of Omzban of an application for an Official Plan Amendment to extend the 0ewtooville Hamlet boundaries in order to implement this development. On November 4, 1988, the Town of Newcastle Planning Department received notice from the Region of Durham of an application for approval of a Plan of Subdivision. The applications for rezoning and Plan of Subdivision were circulated concurrently with the Official Plan Amendment Application. ` 1.3 A Preliminary 8vdrogeoIogioal Report and Environmental Conditions Report' prepared by a consultant for the applicant was submitted with this application. 2. OFFICIAL PLAN AND ZONING BY-LAW 2.1 The subject property is presently designated "Major Open Space" and "Hazard Lam]a" in the Durham Region Official Plan, and are zoned "Agricultural" and "Environmental Protection" in the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended. 3. PUBLIC NOTICE 3.1 The appropriate siguage acknowledging the application was installed on the subject lands, and surrounding property ovmusza were advised of the proposal in accordance with the requirements of the Planning Act and Council policy. 4. CIRCULATION 4.1 The subject application was circulated by the Town and the Region to various agencies and departments to obtain comments. The following department/agencies offered no objection to the proposal: 3. . . j U L 1 � 07 | REPORT 0O. : DD-30-89 9&QE 3 _______________________________________________________________________________ - Town of Newcastle Building Department - Ministry of Agriculture and Food - The Northumberland & Newcastle Board of Education - The Peterborough, Victoria, Northumberland and Newcastle Roman Catholic Bobuol Board The following departments/agencies offered no objection to proposal in principle, but have outlined conditions for Draft Plan approval: - Gaoaraoho Region Conservation Authority - Ministry of Natural Resources - Ministry of Transportation 4.2 The Town of Newcastle Public Works Department have noted that they have no objection to application in principle however, recommend that the development not proceed until such time as the applicant has addressed the following concerns: l. The Conceptual Site Servicing Report *biob deals with, amongst other items, open ditch drainage, lot grading and easements required to drain storm water runoff; 2. The intersection of Payoea Crescent, Road Allowance between Lots G and 7 and Road Allowance between Concessions I and 2 will require n preliminary alignment to determine street naming, through streets -and if road vvideoiogo will be required to compensate the existing offset; 3. The future of unopened road allowances needs to be addressed (eg, closure and conveyance?) and legal access to the undeveloped lands. Furthermore, the Town of Newcastle Public Works Department have outlined a number of concerns to be addressed through Draft Approval of this subdivision. 4,3 The Town of Newcastle Fire Department expressed concern with this application, noting that no building permits be issued until aooeoo routes and adequate water for fire fighting are in compliance with the Ontario Building Code. 4. . . 1 � 0 � REPORT N0. : PD-30-89 PAGE 4 _______________________________________________________________________________ 4.4 The Region of Durham Department of Health Services noted that they are not in support of this proposal without municipal water supply. 4.5 The Region Of Durham Works Department comments are as follows: We have reviewed the proposal to amend the Durham Regional official Plan and comment as follows: The application indicated that the proposed development will be no municipal water and private sewage disposal systems. The proposed 0ewtouviIle municipal water system is being sized to accommodate m maximum of 345 residential units. Amendment No 217 to the Durham Regional official PImu indicated that 345 housing units could be developed within the hamlet. Since the subject application is for lands outside the hamlet boundary and municipal water supply will be fully allocated within the hamlet we are unable to provide municipal water to these lands. We therefore moat witbold favourable comment on this Official Plan Amendment application. . 4.6 Comments from Ontario Hydro and the Ministry of the Environment have not been received to date. 5. COMMENTS 5.1 The preliminary Hydcogeological Report submitted by the applicant bases its conclusions upon related soils investigations, a survey of neighbouring wells and Ministry of Environment well water data. Although it is the opinion of the 000auItnut that the site is suitable for development, the consultant also acknowledges that a number of water quality interference complaints have been registered with the Ministry of the Environment for the Hamlet of 0ewtooville. Since the report is not based on test drilling and acknowledges the need for additional field work, the study is inconclusive. 5.3 Amendment 0o. 217 to the Dncbom Regional official Plan recognizes the Hamlet of 0ewtouville as a hamlet for growth which can only develop on municipal water supply up to 345 residential units. There are approximately 125 existing houses and small vacant lots of record in 0ewtouville. Since the hamlet will be limited to 345 housing units a total of 220 units are available for new development. 1F ') [l 5 REPORT 00. : PD-30-89 PAGE 5 _______________________________________________________________________________ 5.3 A joint Regional report of the Commissioners of Works, Finance and Planning Depnztnvsota' dated January 10, 1989' notes that amendment 0o. 217 requires developers of vacant lands in the hamlet to pay the respective share of the cost of the municipal water system in addition to the payment of development levies prior to the extension of municipal water to 0swtouvilIo. Agreements have been arranged to provide contributions for 160 units, and Regional Staff have also received letters of intent to provide fom]o for 47 additional units. This represents 207 of the 230 units available for new development. 5.4 In addition, there are 220 units available to anc000date further residential growth in 0ewtouviIIe and it would be premature to contemplate expanding the hamlet at this time. 6. CONCLUSION AND RECOMMENDATIONS 6.1 Given the above, and in view that the Regional Works Depaztnveot have commented that municipal water services will not be extended to the subject site, and that the Regional Health Unit cannot support this application without municipal water services, Staff are unable to support this application and Staff would respectfully recommend that the various applications by VeItzi and Goua Ltd. for an 84 lot residential subdivision be DENIED.
