SUBJECT: REZONING APPLICATION - ARMOND YOUNG
PART LOT 19, CONCESSION 1, FORMER TWP. OF CLARKE

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-29-89 be received; and
2. THAT the rezoning application submitted by Armond Young on behalf of Bouf's
Investments to rezone a 4039 sq.m. (1 acre) parcel to an appropriate zone to
permit the development of three (3) lots be referred back to Staff for
further processing and the preparation of a subsequent report upon
satisfying all outstanding concerns; and
3. THAT the applicant be so advised.
1. BACKGROUND:
1.1 In November, 1988, the Planning and Development Department received an
application from Armond Young on behalf of Bouf's Investment to amend the
Town's Comprehensive Zoning By-law 84-63, as amended. The application
proposes to rezone a 4039 sq.m. (1 acre) parcel of land from "Agricultural
(A) " to allow the development of three (3) additional non-farm residential

lots in conjunction with abutting lauds which are currently zoned
"Rural Closter (8C)n.
1.2 The property is located in Lot 19' C000eeoimo I, former Township of
Clarke, on the south aide of Highway No. 3. Surrounding land uses
along Biobvmpv 0o~ 2 on the east and west side of the subject property
are residential within the ''8oraI Cluster (RC)" zone. Beyond the
existing residential dwellings the lands are vacant and would appear to
be used for agricultural purposes.
1.3 The rezoning application was submitted as a result of Staff's comments
to Land Division Committee on Applications QD 6I7/88 to LD 6I9/88
inclusive. These consent applications submitted by Boof"a Investments
to create three (3) residential lots having lot areas of I680 aq.m.
(0.42 acre) instead of the required 3000 og.m. (0.74 acre) were not
supported by staff and as a result the Land Division Committee tabled
the applications to allow the applicant an opportunity to satisfy the
Tovmz.
1.4 Staff vm/old note for the Committee's information that pursuant to
Council's resolution of July 26, 1982 and the requirements of the
Planning Act, the appropriate sigoage acknowledging the application
was installed on the subject Imodsv and property owners within 150m
(400 ft) of the subject site were mailed notices of the application
informing them of the Public Meeting dote.
2. OFFICIAL PLAN CONFORMITY
2.1 The subject lands are designated "General Agricultural" in the Durham
Regional Official Plan. The predominant use of lands within said
designation shall be for agricultural and farm-related uses. In
addition, Section I0.2.1.3 allows limited new non-farm residential
dwellings as an exception in the form of new clusters within the
General Agricultural Areas, and provided that such development is
recognized in the local municipality's Dnuiog By-law.

2.2 New residential development within a Cluster may be in the form of
iufilIiog between two dwellings within the boundary of a Cluster as
defined in the local Zoning By-law. The application would appear to
comply with the provisions of the Regional Official Plan.
3. COMMENTING AGENCIES
3.1 In accordance with departmental procedures, the application was
circulated to a number of departments within the Town of Newcastle as
well as e number of outside agencies. To date all but three (3)
agencies, Regional Planning, Regional Public Works and Ontario Hydro
have provided written comments.
3.2 Staff note that the agencies which have responded (Newcastle Public
Works Department, Newcastle Fire Department, Regional Health
Department, Ministry of Agriculture and Food, and Ministry of
Transportation) all had no objection to the proposed zoning amendment.
Verbal comments from Regional Planning also provided no objection.
3.3 Newcastle Public Works Staff note that o grading plan would be
required as a condition of Iom] severance. Ministry of Transportation
Staff have noted that all buildings on the proposed Iota will require
a 14m (45 ft.) front yard setback from the Bigboaav No. 2 property
line. The Tnvml/o Dnuiog By-law only zegoizea a 10m (33.0 ft.) front
yard setback in the "Rural Cluster (RC)II zone. No other comments or
conditions were requested from commenting agencies.
4. COMMENTS:
4.1 Staff have reviewed the application with regards to the provisions of
the Regional Official Plan for rural non-farm related residential
development. As noted above, limited non-farm residential may take
place in the form of Clusters if recognized within the local Zoning
By-law. New development within a Cluster may be in the form of
iufilliog between two dwellings.

In addition, Staff note that Regional policies specify non-farm
residential uses sboII be serviced with a private drilled well and a
private waste disposal system.
4.2 Staff have concern with regards to the issue of potable water and soil
conditions for the proposed lots. In consideration of the number
of existing lots and residential units within the immediate vicinity
of the proposal, Staff are concerned that the creation of three lots
and subsequent wells and septic systems may adversely impact existing
residential development within the cluster.
4.3 In consideration of Staff's ooucezoa as noted above the applicant is
required to submit an Engineer's report based on teat drilling, which
confirms an adequate supply of potable water and soil conditions
satisfactory for private servicing.
5. RECOMMENDATION:
In consideration of the above comments, namely Staff's 000cezuo with
regards to private services and the comments outstanding, Staff umoId
recommend that the application be referred back to Staff until such
time that the outstanding oVocecua have been addressed.
