SUBJECT: SALE OF DOG LICENSES
FILE: PLN 5.2.3
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-25-89 be received; and
2. THAT the Director of Planning and Development be authorized to take
appropriate actions to implement the policies contained in Item 3.1 of this
Report.
1. ORIGIN:

1.1 At its meeting on January 9, 1989, the General Purpose and Administration
Committee directed Staff to investigate and report on the issue of sales of
Dog Licenses from various outlets in the Town.

2. BACKGROUND:

2.1 For many years, the sales of Dog Licenses were available in the following
locations:
a) Licence Bureau, 157 King St. E. , Bowmanville
b) Hopes variety, 15 King St. W. , Newcastle
c) McInnis Mini Mart, Main Street, Orono
d) Animal Control Office, Liberty Street and Hwy. 401.

2.2 These operators were given a commission of $2.00 for every licence
sold and were to deposit the money with the Town on a weekly basis.
In 1988, the estimated commission was $1,6010.0101. It should be noted
that there was no formal Council authorization to permit the sales of
licenses by others nor was there any formal agreement between the Town
and the Operator to set out the commission fee, the manner and
procedure for book keeping. Apparently, all arrangements were verbal
and it was the previous By-law Enforcement Officer who took it upon
himself to initiate such undertaking.
2.3 At the beginning of this year, the current By-law Enforcement Officer
cancelled the sales outlet and all dog owners have to purchase
licenses from the Town Hall. The rationale was that it enables the
Town to save the commission fee as well as to enable Staff to have a
better control and record of licenses sold.
3. COMMENTS:
3.1 I have reviewed this matter and would like to recommend the following
policies:
a) Maintain the current outlets in Newcastle Village, Orono & in
Animal Control Depot
b) Seek new outlet in Courtice
c) Eliminate outlet in Bowmanville (Licence Bureau) and replaced by
outlet in Town Hall
d) Operators of all outlets are required to enter a simple agreement
with the Town to formalize the commission fee and procedures. A
copy of a draft agreement is attached to this report.
e) Eliminate sale of dog licences by summer student.
3.2 Due to the vast geographical make-up of this municipality, it is
prudent that we establish sales outlets for dog licenses for the
convenience of the residents, which in my view, is essential and
would outweigh the benefit of saving in commission fee.

AGREEMENT MADE (IN TRIPLICATE) THIS DAY OF 1989.
BETWEEN:
---------------------------------------------------
hereinafter called the "Operator" of the first part
- and -
--------------------------------------------------------
hereinafter called the "Municipality" of the second part
WHEREAS the Municipality authorizes the Operator to issue dog licenses on behalf of
the Municipality; and
WHEREAS it is deemed necessary to set out certain terms and conditions related
thereto;
NOW THEREFORE, in consideration of the mutual agreements and covenants hereinafter
contained, the parties hereto agree as follows:
1. The operator agrees to issue dog licenses on behalf of the Municipality in
accordance with procedures as prescribed by the By-law Enforcement Officer.
2. The Municipality agrees to reimburse the Operator the sum of Two Dollars
($2.00) for every dog licence sold.
3. The Operator agrees to submit to the By-law Enforcement Officer on a weekly
basis the following:
a) list of names of dog owners, addresses, licence numbers, fee charges,
and other pertinent information as required by the By-law Enforcement
Officer; and
b) all money collected from the sales of dog licenses minus the commission
fee referred to in Paragraph 2.
4. The parties agree that this Agreement can be cancelled by either party within
one (1) month of receipt of written notice to terminate.
IN WITNESS WHEREOF the parties hereto have hereunto set their hands and seals the
day and year first above written and the parties hereto have hereunto affixed their
corporate seals by the hands of their proper officers duly authorized in that
behalf.
