THAT Report PD-81-92 be received; 2 . THAT the application to amend the Town of Newcastle Official Plan and Comprehensive Zoning By-Law 84-63 as submitted by G.M. Sernas & Associates Ltd. on behalf of 865742 Ontario Limited "In Trust" be referred back to Staff for further processing and preparation of a report subsequent pending receipt of all outstanding comments; and, 3 . THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1. 1 Applicant: 865742 Ontario Limited "In Trust" 1. 2 Agent: G.M. Sernas & Associates Ltd. 1. 3 Official Plan Amendment: To increase the densities permitted within the "Low Density Residential" designation to permit proposed residential uses 1.4 Rezoning: From "Urban Residential Type One (R1) 11 and "Agricultural (A) " to an appropriate zone(s) to permit proposed residential uses 2 REPORT NO. : PD-81-92 PAGE 2 1.5 Plan of Subdivision: 18 street townhouse units, 20 semi- detached/link units and 15 single family detached units 1. 6 Site Area: 2 .485 hectares (6. 14 acres) 2. LOCATION 2 . 1 The subject property is a 2 .485 hectare (6. 14 acre) site on the east side of Liberty Street north of the C.P. Rail line in Bowmanville. Public roads located on the west side of Liberty Street include Meadowview Boulevard and Sunnicrest Avenue. In legal terms, the property is known as Part Lot 10, Concession 2 in the former Town of Bowmanville. 3. BACKGROUND 3 . 1 On January 29, 1992, G.M. Sernas & Associates filed an application with the Town of Newcastle, on behalf of 865742 Ontario Limited "In Trust" , to amend the Town of Newcastle Official Plan and the Comprehensive Zoning By-Law 84-63 . The purpose of the application is to amend the Official Plan from "Low Density Residential" and the Zoning By-Law from "Urban Residential Type One (R1) " and "Agricultural (A) " to permit the proposal. 3 .2 The applicant created the property through a combination of land assembly and the land division process. The applicant purchased the properties known as 223 Liberty Street North and 241 Liberty Street North. The residential dwellings were severed from the following properties through Land Division Committee: 221 Liberty Street North (LD 247/91) 227 Liberty Street North (LD 246/91) 239 Liberty Street North (LD 245/91) . . . 3 REPORT NO. : PD-81-92 PAGE 3 The remaining portions of these properties were retained by the applicant and merged with the above-mentioned addresses to create the parcel subject to this proposal. 4. EXISTING AND SURROUNDING USES 4. 1 Existing Uses: Existing Residential and Vacant 4. 2 Surrounding Uses: North: Vacant - Proposed Subdivision 18T-87057 East: Vacant - Proposed Subdivision 18T-87057 South: Vacant - Proposed Subdivision 18T-87057 West: Existing Residential 5. OFFICIAL PLAN POLICIES 5. 1 Within the existing 1976 Durham Region Official Plan, the subject lands are designated "Residential Areas" . Predominant uses of lands within this area shall be for housing purposes. Within the Regional Council adopted 1991 Durham Regional Official Plan, these lands are designated "Living Area" . Again, the predominant use of such lands shall be for housing purposes. According to the Durham Region Planning Department, the proposal conforms to both Durham Regional Official Plan documents. 5.2 The Town of Newcastle Official Plan (Bowmanville Major Urban Area) designates the subject lands, located in Neighbourhood 2C, as "Low Density Residential Area" . Development within this designation shall not exceed a net residential density of 30 units per hectare. The subdivision as proposed would develop at a net residential density of 30.8 units per hectare. The applicant has applied to amend the Town's Official Plan to permit the proposed development. . . . 4 REPORT NO. : PD-81-92 PAGE 4 6. ZONING BY-LAW CONFORMITY 6. 1 The subject lands are currently zoned "Urban Residential Type One (R1) " and "Agricultural (A) " within the Town of Newcastle Comprehensive Zoning By-Law 84-63 . The "Urban Residential Type One (R1) " zoning relates to the residential uses immediately adjacent to Liberty Street North. The "Agricultural (A) " zoning pertaining to the remainder of the applicant's lands does not permit urban residential development as proposed in this draft plan of subdivision. The applicant is seeking a zoning by-law amendment to accommodate the mix of residential housing types in this proposal. 7. PUBLIC NOTICE AND SUBMISSION 7. 1 Pursuant to Council's resolution of July 26, 1982 and requirements of the Planning Act, R. S.O. 1990, the appropriate signage acknowledging the application was erected on the subject lands. The required notice was mailed to each landowner within the prescribed distance. 7. 2 As of the writing of this report, no written submissions have been received. One area resident has requested information regarding unit mix within this subdivision. 8. AGENCY COMMENTS 8. 1 The application was circulated to solicit comments from other relevant agencies. 8. 2 Comments indicating no objections have been received from the following agencies: Durham Region Planning Department Bell Canada . . . 5 REPORT NO. : PD-81-92 PAGE 5 Ministry of Natural Resources Peterborough Victoria Northumberland and Newcastle Separate School Board 8 .3 The following agencies have no objections to the proposal provided that the comments/concerns are addressed by the applicant: Town of Newcastle Community Services Department Town of Newcastle Fire Department Northumberland and Newcastle Board of Education Ontario Hydro 8.4 Comments still remain outstanding from the following agencies: Town of Newcastle Public Works Town of Newcastle Hydro C.P. Rail Canada Post Corporation Central Lake Ontario Conservation Authority Ministry of Environment 9. STAFF COMMENTS 9. 1 Staff wish to inform Committee that the increased density proposed in this plan may slightly alter the planned population targets for this neighbourhood. Therefore the applicant has applied to amend the Town's Official Plan permitting an increased density and population for this development.
