Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD- 63 -92 be received;
2 . THAT the Official Plan Amendment application and Zoning By-law
Amendment application submitted by Ridge Pine Park, to permit the
continued use of the subject property with a Sales Office with four
(4) model homes and add as permitted uses a recreation centre and
a 170 unit structure consisting of 110 retirement home units and
60 nursing home units, be referred back to Staff for further
processing pending the receipt of all outstanding comments.
3 . THAT the interested parties listed in this report and any
delegation be advised of Council's decision.
1. APPLICATION DETAILS
1. 1 Applicant: Ridge Pine Park Inc.
1.2 Official Plan Amendment:
From Permanent Agricultural Reserve to an
appropriate designation to permit the continued use
of the subject property with a Sales Office with
four model homes and add as permitted uses a
recreation centre and a 170 unit structure
consisting of 110 retirement home units and 60
nursing home units.

From "Agricultural (A) " to an appropriate zone in

2 . BACKGROUND
2 . 1 On July 5, 1988, the Town of Newcastle Planning and Development
Department received an application from Ridge Pine Park Inc. to
amend By-law 84-63 . Subsequently, the Town was advised by the
Regional Planning Department of an application submitted by Ridge
Pine Park Inc. to amend the Durham Regional Official Plan.
2 . 2 The proposal is situated on a 3 .77 hectare (9. 3 acre) parcel of
land located on the west side of Wilmot Creek Road north of the
Canadian National Railway but is more formally described as Part
Lot 3 , Broken Front Concession in the Former Township of
Darlington.
2 . 3 A Public Meeting was held on Monday October 3 , 1988 at which time
four area residents expressed concerns regarding the proposed
development with respect to the impact the proposal may have on the
existing mobile home park. Since a substantial amount of time has
lapsed since the original Public Meeting and since the applicant
has added a recreation centre to the proposal, Staff were of the
opinion that a second Public Meeting was warranted in order to
ensure that the requirements of the Planning Act were satisfied.
3 . PUBLIC NOTICE
3 . 1 Pursuant to Council's resolution of July 26, 1982 and the
requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject lands.
In addition the appropriate notice was mailed to each landowner
within the prescribed distance.
3 . 2 As of the writing of this report, the Planning and Development
Department has not received any written submissions or telephone
inquiries with respect to the proposal.

4. OFFICIAL PLAN CONFORMITY
4. 1 Within the existing and recommended Durham Regional Official Plans
the subject property is designated as Permanent Agricultural
Reserve and therefore, the predominant use of land shall be for
agricultural and farm-related uses. Since the applicant is
proposing to develop the site with non-agricultural uses, an
amendment to the Durham Regional Official Plan is required.
5. ZONING BY-LAW COMPLIANCE
5. 1 Within the Town of Newcastle Comprehensive Zoning By-law 84-63, the
subject property is zoned "Agricultural (A) " which permits the use
of the subject property for agricultural and farm related uses.
Since the applicant is proposing to develop the subject property
with non-agricultural uses, an amendment to the By-law is required
in order to permit the development.
6. AGENCY COMMENTS
6. 1 In accordance with departmental procedures, the zoning by-law
amendment application was circulated to obtain comments from other
departments and agencies. In addition , the Regional Planning
Department has undertaken a circulation of the related Official
Plan Amendment application. However, since the revised plans have
only recently been circulated, the Planning and Development
Department has not received any agency comments, as of the writing
of this report.
7 . STAFF COMMENTS
7. 1 As the purpose of this report is to satisfy the requirements of the
Planning Act with respect to the Public Meeting and in
consideration of the outstanding comments, it would be in order to
have the application referred back to Staff for further processing.
