MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR THE MEETING OF JANUARY 2 , 1992
FILE: A91/040 AND A92/001
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-29-92 be received; and
2 . THAT Council concur with the decisions of the Committee of
Adjustment made at its meeting of January 2 , 1992 .
3 . THAT Staff be authorized to appear before the Ontario
Municipal Board to defend the decisions of the Committee of
Adjustment in the event of an appeal.
1. 1 The Committee of Adjustment heard two (2) applications on
January 2 , 1992 . Both application A 91/040, previously TABLED
and application A 92/001 were APPROVED subject to conditions.
1. 2 Application A 91/040, TABLED at the December 12 , 1992 meeting,
proposed to permit the continued construction of an accessory
structure, prior to the development of the main dwelling. As
a condition of approval the Committee required the removal of
an existing small accessory structure and travel trailer. In
addition, the applicant must sign an undertaking confirming
the erection of a dwelling, in compliance with the Town's
Comprehensive Zoning By-law, will commence within 18 months
of the Committee's decision.

1. 3 Application A 92/001 was submitted proposing to erect an
accessory building (garage) having an exterior side yard of
2 .74 m (9. 0 feet) as opposed to the required 6. 0 m (20. 0 ft. )
minimum.
The lot is in the Hamlet of Burketon and abuts a Town owned,
unopened road allowance. The application was APPROVED subject
to satisfying the requirements of the Durham Region Health
Department, prior to issuance of building permit.
1. 6 Staff have reviewed the decisions of the Committee and are
satisfied that the decisions conform to the general intent of
the Official Plan and the Zoning By-law and that the variances
sought are minor in nature and conditions imposed can be
carried out.
1. 7 Council's concurrence with the Committee of Adjustment
decisions is required in order to afford Staff's official
status before the Ontario Municipal Board in the event of
appeal of the decisions of the Committee of Adjustment.
