Subject: WASTE MATERIAL CLEAN-UP OF PROPERTY OF LEONARD WALLACE
PART LOT 17, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 THAT Report PD_ 23 -92 be received; and
2 . THAT the Municipal Law Enforcement Officers be authorized to
undertake all necessary actions to clean up the property of
Leonard Wallace; and
3 . THAT any expenditure related to the cleanup be in accordance
with Council adopted policies; and
4 . THAT all costs associated with the cleanup be charged initially
against Contingency Account # 7007-00000-0298 and subsequently
levied against the property and to be collected in a like manner
as taxes in accordance to the Municipal Act.
1. REPORT:
1 . 1 On September 20, 1991 an inspection of the vacant property located
at Part Lot 17 , Concession 2, former Township of Darlington was
conducted as a result of complaints the By-law Enforcement
Department had received re persons dumping waste material. Upon
inspection much waste material was noted on the property ( .e.g.
metal pieces, shingles, wood, household garbage) .
1.2 On September 24, 1991 a letter was sent to Mr. Leonard Wallace,
owner of the property, to bring the situation to his attention and
also instructing him to remove the waste material from his property
by October 21, 1991.
1. 3 During the beginning of October the subject attended the office and
spoke to staff. He advised that he knew the material was there,
but at the present time he was ill and would be hospitalized. He
indicated he would not clean it up now, but would, once he was
better.

1.4 On October 23, 1991 another letter was sent to Mr. Wallace. This
letter indicated that staff realized he had medical problems and
would extend the removal date to November 18, 1991.
1. 5 The property in question was re-inspected after this date, and the
material was still present.
1. 6 On November 27, 1991 a registered letter was sent to Mr. Wallace
indicating the By-law Enforcement Department would be proceeding
with legal action and would be making a request to Council to
obtain authorization to have the debris removed at his expense if
it was not removed by December 6, 1991.
1 . 7 On December 3, 1991 the By-law Enforcement Department received a
telephone call from a man who identified himself as the brother of
Mr. Wallace. He indicated his brother was not well but he would
ensure the debris was removed on the weekend of December 7th and
8th, 1991.
1. 8 On December 9, 1991 the property was re-inspected and the debris
still had not been removed.
1. 9 On December 13, 1991 it was noticed that some "work" had been
initiated on this property. Upon inspection it appeared that the
debris close to Nash Road had in fact been pushed and dispersed
to the south of its initial location. This inspection revealed
that the waste material located on the property was in fact,
larger than initially thought. Numerous tires, pieces of drywall,
metal appliances and derelict vehicles were noted to be scattered
throughout the property.
1 . 10 The Waste Material By-law 90-160 Section 6, makes provisions for
the By-law Enforcement Department to carry out any necessary work
which the subject has defaulted. This would include the removal
and disposal of the waste material. The costs associated with
this procedure would be initially charged against Contingency
Account 7007-00000-0298 and subsequently against the property and
recovered in a like manner as taxes .

1. 11 The By-law Enforcement Department will be initiating legal action
against Leonard Wallace pursuant to the Waste Material By-law 90-
160 . Though it appears an attempt to clean up has been started, ,
it is questionable as to how diligent the owner will be in his
efforts . Upon realization that the problem is larger than initially
anticipated, staff urge Council for authorization to complete the
work. Attached are copies of some of the photographs taken of the
site.
