Subject: APPEAL OF ZONING AND OFFICIAL PLAN AMENDMENT TO
ONTARIO MUNICIPAL BOARD - PARTICIPATION HOUSE
PART LOT 8, CONCESSION 2, FORMER TOWN OF BOWMANVILLE

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . THAT Report PD-79-91 be received for information.
1. PURPOSE
The purpose of this report is :
a to advise Council that the Ontario Municipal Board Hearing
for the Participation House proposal has been scheduled for
the week of July 29 in the Council Chambers .
b) that Planning Staff will not be participating at the hearing.
2 . LOCATION
The subject property is presently vacant and is located in Part
Lot 8, Concession 2, former Town of Bowmanville. Located to the
east of the site is the Soper Creek and associated valley lands.
To the west of the site is a dwelling unit which had been used in
the past as a Day Care, to the south are single dwelling units
fronting on Concession Street. To the north of the lands is a
Draft Approved Plan of Subdivision (18T-88039) .
3. BACKGROUND
Report PD-240-90 was presented to General Purpose and
Administration Committee on July 16, 1990, recommending approval
of Official Plan and Zoning amendments as related to the 40 unit
residential development proposed by Participation House.

3 .2 Subsequent to consideration of Report PD-240-90, Council approved
GPA recommendation as follows :
"THAT the application to permit the development of 40
Townhouse units be DENIED" and
"THAT the Province of Ontario be notified that the Town of
Newcastle is prepared to address the Participation House
concept, but not to the density level specified in Report PD-
240-90"
3 . 3 The Town Clerk was advised by correspondence dated October 10,
1990, that "The Participation House Project" had filed an appeal
to the Ontario Municipal Board on Council's denial of their
By-Law Amendment application. Subsequently, the Official Plan
Amendment application submitted by Participation House was also
referred to the Board. The Board has scheduled the Hearing during
the week of July 29 to August 2, 1991 to be held in the Council
Chambers at the Municipal Administration Centre.
4 . COMMENTS
4 . 1 Since Staff's recommendation is contrary to Council 's decision,
there will be no Staff involvement at the upcoming Ontario
Municipal Board hearing except for procedural matter or appearance
under subpeona. Should Council wish to defend its denial decision
before the Board, Council may direct a planning consultant be
retained. The cost of legal and planning consultant fees for the
hearing is estimated to be $20,000 . which has not been accounted
for in the 1991 Budget.
