MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR THE MEETING OF JANUARY 31, 1991
FILE: A91/002 - A91/004 INCLUSIVE
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-45-91 be received; and
2 . THAT Council concur with the decisions of the Committee of
Adjustment made at its meeting of January 31, 1991; and
3 . THAT Staff be authorized to appear before the Ontario Municipal
Board to defend the decisions of the Committee of Adjustment in the
event of an appeal .
1. BACKGROUND
1 . 1 The Committee of Adjustment heard applications on January 31, 1991.
The Committee dealt with a total of three (3) applications during
the one ( 1) meeting approving two and tabling the third.
1 . 2 Application A91/004 requested a reduction of the required side yard
from 1.2 m (4 . 0 ft. ) to 0 . 6 m (2 ft. ) . The applicant's neighbour
was in attendance at the meeting in objection to the applicaiton.
The Committee upon hearing all facts and issues decided they could
only support the application if the variance was reduced to 0 . 2 m
( 0 . 65 feet) from 0 . 6 m (2 ft. ) , thereby leaving a 1. 0 m ( 3 .28 ft. )
side yard.

1. 3 Staff in providing comments to the Committee could not support
applications A 91/004 as filed. The Committee's decision to reduce
the variance, thereby increasing the sideyard appears appropriate.
Staff are in support of the Committee's decision.
1 . 4 The Committee's decision to table one application, was to allow the
applicant to clarify the height of the building and variance
required. The application will be heard at the next available
meeting.
1.5 Staff have reviewed the balance of the decisions of the Committee
and are satisfied that the decisions conform to the general intent
of the Official Plan and the Zoning By-law and that the variances
sought are minor in nature.
1. 6 Council's concurrence with the Committee of Adjustment decisions
is required in order to afford Staff's official status before the
Ontario Municipal Board in the event of appeal of the decisions of
the Committee of Adjustment.
