ANFOSSI PART LOT 15, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON FILE: DEV 88-107 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . THAT Report PD-38 -91 be received; 2 . THAT application DEV 88-107 be closed upon the request of the applicant. 3 . THAT the Durham Region Planning Department and interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1. 1 Applicant: David Sims Q.C. 1 .2 Owner: Dr. H. Anfossi 1 . 3 Rezoning: From: "Agricultural (A) " and "Environmental Protection (EP) " To: a zone appropriate to permit the creation of a 1. 137 ha parcel and a 2 .91 ha parcel. 1 . 4 Area: 4 . 047 hectares i , t . . . .2 REPORT NO. PD- 38 -91 PAGE 2 2 LOCATION 2 . 1 The subject property is located in Part of Lot 15, Concession 2 former Township of Darlington. The lands can be further described as being located on the east side of Nash Road where Nash Road changes from a north-south direction to an east-west direction. 3 BACKGROUND 3 . 1 On October 4, 1988, the Town of Newcastle Planning Department received an application to amend the Town of Newcastle Comprehensive Zoning By-Law 84-63, as amended. The applicant wanted to sever his property hence creating two separate building lots . 3 .2 A Public Meeting was held on January 23, 1989 at which time Staff recommended in Report PD-18-89 that the application be denied. A number of factors supported Staff's position including the following: the proposal does not meet the requirements as set out in the Durham Region Official Plan (Section 10 .2 . 1. 3) to qualify as a Rural Cluster; and physical topography constraints (being Bowmanville Creek) limited any buildable lands to the Closed Road Allowance between Concessions 2 and 3 . Council 's resolution at this time was: "THAT Report PD-18-89 be received and referred back to staff for further discussion. " 3 . 3 On January 10, 1991 the Planning Department received a letter from Dr. Anfossi, stating that he could not satisfy the Central Lake Ontario Conservation Authority that enough table land exists to permit development of an additional lot. Accordingly, he has asked that Staff discontinue processing his application. 4 . 0 CONCLUSION 4 . 1 At the owners request, Staff is recommending that Dev 88-107 be closed. t ' . . . .3 REPORT NO.
