THAT Report PD-28-91 be received for information; and 2 . THAT Mr. J. Gordon Elder be advised of Council 's decision. 1. BACKGROUND: 1. 1 Council, at their December 10, 1990 meeting endorsed the following resolution: "THAT the correspondence dated November 29, 1990, from J. Gordon Elder, P.Eng. , Elder Engineering Inc . , requesting comments pertaining to the establishment of a new television transmitting facilities at CKQT's site near Mitchell Corners, be received; THAT the correspondence be referred to the Director of Planning and Development for review and the preparation of a report; and THAT J. Gordon Elder be advised of Council 's decision. " . . .2 I / ) REPORT NO. : PD-28-91 PAGE 2 2 . STAFF COMMENTS: 2 . 1 For the Committee's information, Mr. Elder's request was submitted on behalf of Power Broadcasting Inc . , licencee of CKQT-FM Oshawa and CHEX-TV, Peterborough. 2 .2 Upon contacting Mr. Elder, Staff was advised that Power Broadcasting Inc . recently purchased the existing facilities north-east of Mitchell Corners with the intention of re- establishing the licensing rights of the transmission facilities . 2 . 3 To that end, a licensing application was submitted with DOC- CRTC. Through the Department of Communication requirements an applicant is required to advise the host municipality of their intentions to operate a station. 2 .4 Mr. Elder indicated that the existing facility was previously licensed through GLOBAL-TV, but has not been operational for the past two (2) years when GLOBAL relocated to the CN Tower facilities . Global operations involved a 1000/kilowatt service whereas Power Broadcasting Inc . would involve a 10 Kilowatt service. 2 .5 Notwithstanding the limited service proposed and possible area of interference, CHEX-TV has provided Staff with a copy of a general commitment that is honoured should any interference develop. The commitment states that the holder of the broadcasting certificate shall remedy any complaints of overloading, blanketing and any other type of interference to the reception of broadcast and other radio services caused by the operation of this broadcasting . . . 3 REPORT NO. : PD-28-91 PAGE 3 undertaking, and shall take prompt and appropriate action to correct such adverse effects bearing all costs involved, unless such complaints are of a type judged not valid by the Department of Communications . 2 . 6 It is noted for the Committee's information that within By-law 84-63, Section 3 . 16 entitled "Public Uses " permits the use of any lot or building for the purposes of providing "public services" . For the purposes of this Section, any telephone, cable television, or telegraph company which company possesses all the necessary powers, rights, licenses and franchise is included as providing a "Public Service" and accordingly, a permitted use. 2 . 7 Staff would confirm that the DOC-CRTC does not require a "formal response" to Mr. Elder's letter as their mandate only requires that notification be provided. Therefore, no action is required by the municipality and this report is recommended to be received for information.
