FILE #: A90151 & A90/63 to A90/66 INCLUSIVE SECT: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . THAT Report PD-9-91 be received; and 2 . THAT Council concur with the decisions of the Committee of Adjustment made at its meeting of November 1 and December 6, 1990, save and except for applications A 90/065 and A 90/066; and 3 . THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment in the event of an appeal. 1. BACKGROUND 1 . 1 The Committee of Adjustment heard applications on November 1 and December 6 , 1990. The Committee dealt with a total of five (5) applications during the two (2 ) meetings . Applications A 90/51 was closed by the Committee at the request of the applicant. The balance of the applications were all APPROVED as applied for. 1 . 2 Staff can not support the Committee of Adjustment decision on applications A 90/65 and A90/66 . However, Staff do not feel the decisions should be appealed to the Ontario municipal Board, given the nature of the applications and the Staff time and legal fees involved with a Board hearing. . . .2 REPORT NO. : PD-9-91 PAGE 2 1 . 3 Staff have reviewed the balance of the decisions of the Committee and are satisfied that the decisions conform to the general intent of the Official Plan and the Zoning By-law and that the variances sought are minor in nature. 1 .4 Council 's concurrence with the Committee of Adjustment decisions is required in order to afford Staff 's official status before the Ontario Municipal Board in the event of appeal of the decisions of the Committee of Adjustment.
