THAT Report PD-207-92 be received; 2 . THAT application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by the Town of Newcastle on behalf of Michael, Stewart and Alan Clarke, be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3 . THAT the Durham Region Planning Department, and all interested parties listed in this report and any delegation be advised of Council 's decision. 1 . APPLICATION DETAILS 1. 1 Applicant: The Town of Newcastle 1.2 Owner: Michael, Stewart and Alan Clarke 1. 3 Rezoning: From Agricultural (A) to Environmental Protection (EP) 1 .4 Area: 5 .65 hectares 2 . LOCATION 2 . 1 The subject lands are located in Part of Lot 1, Concession 1, former Township of Clarke on the southwest corner of Highway No. 2 and East Townline Road. It is identified as Block 20 on a draft approved plan of subdivision consisting of 19 estate residential lots . . . . .2 REPORT NO. PD-207-92 PAGE 2 3 BACKGROUND 3. 1 Previously, applications have been submitted on these and the surrounding lands to permit the development of an estate residential development. On July 21, 1992 draft approval for subdivision 18T89007 was granted by the Region. One of the conditions which must be satisfied in order to clear the conditions of draft approval is passage of a zoning by-law amending the zoning on Block 20 to an "Environmental Protection" zone. Both the Ministry of Natural Resources and Ganaraska Region Conservation Authority requested this zone change. 4 EXISTING AND SURROUNDING USES 4 . 1 Existing Uses: vacant 4 .2 Surrounding Uses: East - Agricultural West - Agricultural South - Draft Approved Plan of Subdivision ( 18T89007) North - Agricultural 5 OFFICIAL PLAN POLICIES 5 . 1 The proposed rezoning from "Agriculture" to "Environmental Protection" conforms to the Durham Region Official Plan. 6 ZONING BY-LAW PROVISIONS 6 . 1 The subject lands are currently zoned "Agricultural (A) " . This zone permits farming and other agricultural related activities and uses . As a requirement of the conditions of draft approval for the residential subdivision the lands must be rezoned to "Environmental Protection (EP) " . This zone prohibits buildings or structures . 7 PUBLIC MEETING AND SUBMISSION 7 . 1 Pursuant to Council's Resolution of July 26, 1982 and the . . . . 3 4 REPORT NO. PD-207-92 PAGE 3 requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 8 AGENCY COMMENTS 8. 1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following departments/agencies in providing comments, offered no objection to the application as filed: Town of Newcastle Public Works Ganaraska Region Conservation Authority Ministry of Natural Resources 8.2 The Ministry of Transportation has no objection to the application, but they do advise that access to this property from Highway No. 2 will not be allowed. 8. 3 Comments have yet to be received from the following agencies: Durham Region Planning Department Durham Region Works Department Ministry of Agriculture and Food 9 STAFF COMMENTS 9. 1 The Ganaraska Region Conservation Authority and the Ministry of Natural Resources requested that Block 20 on the draft approved plan of subdivision (18T89007) be zoned Environmental Protection (EP) . As such, Staff are processing this rezoning application, and will prepare a report for Committee and Council's review when comments from the outstanding agencies have been received and when all concerns, if any, have been dealt with. . . . .4 REPORT NO. PD-207-92 PAGE 4 10 CONCLUSION 10. 1 The purpose of this report is to facilitate the Public Meeting as required by the Planning Act, to provide Committee and Council with some background on the application submitted and for Staff to indicate issues or areas of concern regarding the subject application. It is recommended the application be referred back to Staff for further processing and subsequent report upon resolution of the above issues and receipt of all outstanding comments and required revisions.
