THAT Report PD-152-93 be received; 2 . THAT Resolutions #GPA-115-91, #C-204-92 and #GPA-23-93 be rescinded; 3 . THAT Mr. Harvey Ambrose of Courtice Auto Wreckers, the Region of Durham Works Department, all interested parties listed in this report, and any delegation be advised of Council's decision. 1. BACKGROUND 1. 1 The purpose of this report is to deal with two outstanding matters as follows: i) direction by Council to investigate a pilot project for composting within the Municipality; and ii) a proposal by Courtice Auto Wreckers (Ontario Disposal Limited) to establish a yard waste composting facility in Part Lots 31 and 32, Concession 10, former Township of Darlington. 2 . PILOT COMPOSTING PROJECT 2 . 1 On June 11, 1990, Council passed the following resolution (#C- 421-90) : "THAT the Directors of Planning and Public Works investigate the feasibility of the Town of Newcastle, in co-operation with the Regional Municipality of Durham, establishing a pilot project for composting within the Town of Newcastle and report back to the General Purpose and Administration Committee forthwith. " 532 REPORT NO. : PD-152-93 PAGE 2 2 . 2 After some initial investigation, no action was taken on this resolution. The Region of Durham advised that they were initiating a comprehensive yard waste composting project. This made a pilot project in Clarington redundant. 3 . COURTICE AUTO WRECKERS (ONTARIO DISPOSAL LIMITED) 3 . 1 On February 18, 1991, Mr. Harvey (Skip) Ambrose appeared as a delegation before Committee to seek the Town's support for the establishment of a composting site for the Region of Durham, specifically on lands in Part Lots 31 and 32 , Concession 10, former Township of Darlington. Committee, and subsequently Council, endorsed Resolution #GPA-115-91, as follows: "THAT the Town of Newcastle support composting as part of the Three R's; and THAT Council advise Mr. S. Ambrose that it will be prepared to consider an application for Official Plan and Zoning By-law Amendments in this regard. " 3 . 2 On March 23, 1992, Mr. Ambrose appeared as a delegation before Council to request that Council re-affirm the position taken by the previous Council as noted in Section 3 . 1 above. Council adopted the following resolution (#C-204-92) : "WHEREAS on February 25, 1991, the Council of the Town of Newcastle approved Recommendation #GPA-115-91; NOW THEREFORE BE IT RESOLVED THAT this Council re-affirm: THAT the Town of Newcastle supports composting as part of the three R's and that Council advise Skip Ambrose that it will be prepared to consider an application for Official Plan and Rezoning By-law Amendments in this regard; AND FURTHER THAT this matter be referred back to the Director of Planning and Development for the preparation of a full report. " 3 . 3 On May 25, 1992, Mr. Alan McKay appeared as a delegation before a Council meeting to state his opposition to the proposed compost site, noting numerous concerns. Mr. McKay emphasized that the Ministry of the Environment had previously 533 REPORT NO. : PD-152-93 PAGE 3 denied this site for a landfill site because of the sensitivity of the area. 3 . 4 On January 4 , 1993 , Mr. Ambrose appeared as a delegation before Committee to question whether he had the support of the Municipality of Clalington to proceed with an application for a compost facility on his site in Darlington Township. Committee approved, and on January 11, 1993 Council endorsed, the following resolution (#GPA-23-93) : "THAT the delegation of Skip Ambrose with respect to composting facility in the Town of Newcastle be acknowledged; and, THAT, if Mr. Ambrose so chooses, he be invited to apply for a zoning by-law amendment, clearly defining the detail of his application. " 4. STAFF COMMENTS 4 . 1 The lands proposed by Ontario Disposal Limited for a leaf and yard waste composting facility on Part Lots 31 and 32 , Concession 10, former Township of Darlington, are zoned 'M3 - Extractive Industrial' by By-law 84-63 , the Town of Newcastle Comprehensive Zoning By-law. The proposed composting facility is not a permitted use in the 'M3 ' zone. Planning Department Staff, through letters dated April 16, 1992 and May 1, 1992 , advised Ontario Disposal Limited of the need to submit applications for rezoning and Site Plan Approval to permit the proposed composting operation, as well as a traffic impact study to determine the impact of trucks entering and leaving the site on the existing road system. To date, Ontario Disposal Limited has not submitted the necessary applications and studies. 4 . 2 Staff attended a meeting between Regional Staff and Mr. Ambrose on January 25, 1993 regarding an agreement between the two parties for the operation of a yard waste composting facility. Mr. Ambrose verbally indicated at that time that he � JI REPORT NO. : PD-152-93 PAGE 4 would not be pursuing the establishment of a yard waste composting facility at his site in Darlington Township. It is Staff's understanding that Courtice Auto Wreckers is pursuing other opportunities to establish composting operations elsewhere in the Region, including possible sites in Oshawa and Brock Township. 4 . 3 On February 1, 1993 and again on September 15, 1993, Staff wrote to Mr. Ambrose requesting that he confirm his intentions with respect to proceeding with an application for a composting facility on his site in Darlington Township. Mr. Ambrose did not respond to either letter. 4 .4 Finally, Staff managed to meet with Mr. Ambrose on October 20, 1993 to ascertain for the last time as to his intention. At the meeting, Mr. Ambrose gave the impression that although he has no immediate plan for the site, he does not wish the municipality to close the "file" . The Director of Planning advised Mr. Ambrose that there is "nothing" to close since he has never made any rezoning application to the municipality. 4 .5 Subsequent to the meeting with Mr. Ambrose, it appears that Mr. Ambrose is uncertain as to whether or not or when he wishes to proceed with his proposal nor did he agree to submit a rezoning application and provide detail information such as traffic impact and nature of operation. It is impossible for staff to deal with a proposal which was never put in writing through a rezoning application to the municipality. 5. CONCLUSIONS 5. 1 Given the Region's intention to initiate a comprehensive yard waste composting project, no further action should be contemplated by Municipal Staff. 5. 2 With respect to Mr. Ambrose's proposed composting facility, staff cannot assess his proposal due to lack of information. REPORT NO. : PD-152-93 PAGE 5 This, plus the fact that Mr. Ambrose gave the indication at the recent meeting he has no immediate plan to proceed, it is prudent that staff not spend any more time with Mr. Ambrose and therefore recommend all previous resolutions related thereto be rescinded.
