Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-138-95 be received;
2. THAT Resolution #GPA-390-90 be RESCINDED and that Rezoning Application DEV 89-
049 submitted by Blair Culham on behalf of Lloyd Taylor of Taylor Sand and Gravel be
CLOSED.
3 THAT the Durham Region Planning Department, and all interested parties listed in this
report and any delegation be advised of Council's decision.
1. BACKGROUND
11 In 1989, applications were received for an Official Plan Amendment (OPA 89-
004/D) and a Rezoning (DEV 89-049) to permit the creation of an aggregate
extraction operation on the subject lands.
12 On May 28, 1990, Municipal Council made the following recommendations:
• that the Region of Durham approve the Official Plan Amendment
Application;
• that the rezoning application be approved, and
• that the amending By-law be passed at such time as the applicant enters
into a site plan agreement with the Municipality, and the Official Plan
Amendment receives Ministerial approval.
These recommendations were forwarded to the Region of Durham.

1.3 The Region received Municipal Council's recommendation but did not proceed
with reporting to Regional Planning Committee as they were awaiting the
submission of additional information. This additional information has yet to be
received. Recently, Regional Staff contacted the owner and were advised that the
owner is no longer interested in pursuing the Official Plan Amendment
Application.
1.4 Regional Staff forwarded a report to Regional Planning Committee recommending
the application be refused. On October 25, 1995 Regional Council adopted
Regional Staff's recommendation and the application was refused.
3. CONCLUSION
3.1 Since the Region of Durham has refused Official Plan Amendment Application
OPA 89-004/D, it is Staff's opinion that Resolution #GPA-390-90 should be
rescinded, as it is no longer relevant, and that the Rezoning Application referred
to as DEV 89-049 be closed.
3.2 The applicant, owner and all interested parties have been advised about this
report and Staff's recommendation herein.
