Date: Monday, November 20, 1995 Res #—_(°1 _9S Report #: PD-1 p7-AS File #: A95.1039 By-law # Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT FOR THE MEETING OF NOVEMBER 9, 1995 FILES: A95/039 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following. 1. THAT Report PD-127-95 be received; 2. THAT Council concur with the decision of the Committee of Adjustment made on November 9, 1995; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decision of the Committee of Adjustment in the event of an appeal. 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received by the Municipality for minor variance are scheduled to be heard within 30 days of being received by the Secretary Treasurer. The Committee approved the application heard. 1.2 Application A95/039 was filed by 649101 Ontario Limited to allow the construction of a link dwelling unit with an exterior side yard setback of 4 4 metres instead of 6 metres. The subject property is an irregular shape on a corner of John Walter Crescent. The builder endeavoured to meet the side yard setbacks but required the minor variance for the rear exterior corner of the dwelling unit. 2 559 REPORT NO.: PD-127-95 PAGE 2 1.3 Staff have reviewed the Committee's decision with respect to the above- referenced application and are satisfied that it conforms to the general intent of the Official Plan and Zoning By-law and is minor in nature. 1.4 Council's concurrence with the Committee of Adjustment decision is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of any decisions of the Committee of Adjustment.
