Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR THE MEETING OF OCTOBER 26, 1995

Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-122-95 be received;
2. THAT Council concur with the decision of the Committee of Adjustment made on
October 26, 1995; and
3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend
the decision of the Committee of Adjustment in the event of an appeal.
I
1.1 In accordance with Section 45 of the Planning Act R.S.O 1990, all applications
received by the Municipality for minor variance are scheduled to be heard within
30 days of being received by the Secretary Treasurer. The Committee approved
all three (3) applications heard.
1.2 Application A95/036 was filed by Paul Greenfield to recognize an existing addition
to a detached garage which exceeds the maximum permitted coverage of 40%
of the principle dwelling unit.

Application A95/037 was filed by Rajinder Angl to recognize an existing exterior
side yard setback of 4.32 metres versus the previously approved setback of 4 34
metres.

Application A 95/038 was filed by Margaret Flintoff to permit the construction of
an accessory building which exceeds the maximum permitted coverage of 40%
of the principle dwelling unit.
1.3 Staff have reviewed the Committee's decision with respect to the above-
referenced application and are satisfied that they conform to the general intent of
the Official Plan and Zoning By-law and are minor in nature.
1.4 Council's concurrence with the Committee of Adjustment decision is required in
order to afford Staff's official status before the Ontario Municipal Board in the
event of an appeal of any decisions of the Committee of Adjustment.
