MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT FOR THE MEETING OF SEPTEMBER 21, 1995 FILES: A95/032 Recommendations. It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 106 -95 be received; 2. THAT Council concur with the decision of the Committee of Adjustment made on September 21, 1995; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decision of the Committee of Adjustment in the event of an appeal. 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received by the Municipality for minor variance are scheduled to be heard within 30 days of being received by the Secretary Treasurer. The Committee approved the one (1) application heard. 1.2 Application A95/032 was filed by Randy Smit to permit the construction of an accessory building having a larger floor area that that permitted by the zoning by -law. The building is proposed to have a floor area of 88 m2 (952 sq.ft.) and required a variance of 27 m2 (290 sq.ft.). 516 ...2 REPORT NO.: PD- 106 -95 PAGE 2 1.3 Staff have reviewed the Committee's decision with respect to the above- referenced application and are satisfied that it conforms to the general intent of the Official Plan and Zoning By -law and is minor in nature. 1.4 Council's concurrence with the Committee of Adjustment decision is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of the decision of the Committee of Adjustment.
