It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -105 -95 be received; 2. THAT the attached By -Law, removing the "Holding (H)" symbol from the subject lands, be APPROVED; 3. THAT the amending By -Law attached hereto be forwarded to Council for APPROVAL; and, 4. THAT a copy of this report be forwarded to the Region Durham Planning Department: 1. APPLICATION DETAILS 1.1 Applicant: Northumberland - Clarington Board of Education 1.2 Rezoning: Removal of "Holding (H)" symbol 1.3 Site Plan Application: To construct a new public elementary school at 385 Beaver Street in Newcastle Village. 2. BACKGROUND 2.1 On March 30, 1995, Zawadzki Armin Stevens Architects Inc. submitted an application on behalf of the Northumberland - Clarington Board of Education for site plan approval and to remove the "Holding (H)" symbol. The subject lands are located at 385 Beaver Street in Newcastle Village, legally described as Part Lots 27 & 28, Concession 1 in the former Township of Clarke. ....2 '510 REPORT NO. PD- 105 -95 PAGE 2 2.2 The removal of the "Holding (H)" symbol would permit development of a new public elementary school accommodating approximately 550 pupils from the Newcastle Village area. 3. STAFF COMMENTS 3.1 The lands are currently zoned "Urban Residential Type One (R1)" and "Holding - Urban Residential Type One ((H)R1)". The "Holding (H)" symbol can be removed upon Council being satisfied that the uses to be permitted will be adequately serviced, have adequate access, and will be used for the purposes intended under the Zoning By -Law. 3.2 The site plan application has been circulated to the appropriate agencies and remains subject to various conditions of approval. The main issue has been the handling of stormwater from the school site. A proposed residential development to the east will require a stormwater management facility. Negotiations are ongoing in order that the school board can accommodate the site's stormwater within the developer's stormwater facility. The school board does have an interim stormwater management solution should the residential development not proceed. 3.3 The new school will be constructed along the eastern edge of the property. Access to the building will be provided on a temporary basis along the southern extent of the property until the developer constructs the road linking the school to the public roadway network. At that point, the temporary access will be closed. 3.4 The school board and the developer have conducted a land exchange through the Land Division Committee. The developer will receive the land for the roadway to the east of the school while the school board receives additional lands along Highway 401. ....3 '511 REPORT NO. PD -105 -95 PAGE 3 3.5 The applicant has entered into a site plan agreement with the Municipality to the satisfaction of the Director of Planning and Development and the Director of Public Works. 3.6 Pursuant to Section 36 of the Planning Act, a Zoning By -Law Amendment to remove the "Holding (H) II symbol is not subject to the normal appeal period applicable to standard rezoning applications, and therefore shall be deemed final and binding should Council grant its approval. 4. RECOMMENDATION 4.1 In consideration of the comments noted above, Staff would have no objection to the removal of the "Holding (H)" symbol as shown on the attached by -law schedule. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By -law 84 -63, as amended, of the former Town of Newcastle to implement application DEV 95 -022 to permit the construction of a public elementary school NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Schedule "5" to By -law 84 -63 as amended, is hereby further amended by changing the zone designation from: "Holding - Urban Residential Type One ((H)R1)" to "Urban Residential Type One (R1)" as shown on the attached Schedule "A" hereto 2 Schedule "A" attached hereto shall form part of this By -law. 3. This By -law shall come into effect on the date of the passing hereof, subject to the provisions of Section 36 of the Planning Act. BY -LAW read a fii st time this day of 1995.
