'g b REPORT NO.7 REZONING APPLICATION FOR R. DUDAR The applicant wishes to have rezoned a lot in Newcastle on the south side of Robert Street west of Church Street. The lot abuts an unopened road allowance which is an extension of Baldwin Street. The Foster Creek also happens to flow along this road allowance at this particular point. The current zoning on the land is OS ®1 which permits no permanent buildings or structures except those used for flood control. The lot has an area of 12,713 sq.f t. but in its natural state was predomin- antly low lying and subject to flooding. Ministry of the Environment contractors placed approximately 12 feet of fill on the lot raising it above the flood plain level. Although the placing of fill in a flood plain may not be desirable, it is not illegal in that part of the municipality under the jurisdiction of the Ganaraska Conservation Authority. The applicant has submitted reports from his own engineer and from the Conservation Authority. Copies of these are attached hereto. Neither of these reports give consideration to the fact that the fill is relatively new and uncompacted and settling of the soil is not yet completed. Any building erected under such conditions is liable to experience shifting or cracking and the municipality should protect any unknowing pruchaser from this hazard. Our building inspector advises that any dwelling erected on this lot would have to have footings going down to undisturbed soil and this could be below the ground water table and this also unacceptable. ® 2 It should be pointed out that regardless of rezoning, all buildings and structures would have to be set back 75 feet from the centre line of any watercourse. This setback is a general provision applying to all zones. In conclusion, I would make the following recommendations: 1) That any change of zoning be deferred until the applicant has satisfied the Town's building inspector that proper foundations can be placed on the site. 2) That subject to 1. above the portion of the applicants land now lying above the flood plain be rezoned Rl in the new by-law now being prepared. 3) That, prior to approval by Council of such rezoning, the applicant enter into a site plan agreement with the Town to implement the conditions required by the Conservation Authority. 4) That the Ganaraska Conservation Authri.ty, who have sole jurisdiction in this matter, be urged to give top priority to the enactment of flood regulations. 5) That the Town establish a policy that no rezoning will be permitted in future where flood plain land has been filled without the prior written consent of the Conservation Authority. (This, while not directly controlling filling operations, will at least ensure that persons who deposit fill without permission will not derive any benefit therefrom in terms of building lots).
