Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR THE MEETING OF SEPTEMBER 7, 1995

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-103-95 be received;
2. THAT Council concur with the decision of the Committee of
Adjustment made on September 7, 1995; and
3. THAT Staff be authorized to appear before the Ontario
Municipal Board to defend the decision of the Committee of
Adjustment in the event of an appeal.
1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990,
all applications received by the Municipality for minor
variance are scheduled to be heard within 30 days of being
received by the Secretary Treasurer. The Committee heard one
(1) application approving same at their September 7, 1995
meeting.
1.2 Application A95/031 proposed the construction of a 111.5 m2
(1200 sq /ft) garage. The Zoning By -law permits accessory
structures to a maximum of 40% of the floor area of the
dwelling. Based on the applicants house size, the Committee
considered a variance from 95.3 m2 to 111.5 m2 to be minor in
nature and desirable. Staff have no objection to the
application.

1.3 Staff have reviewed the Committee's decision with respect to
the above - referenced application and are satisfied that it
conforms to the general intent of the Official Plan and Zoning
By -law and is minor in nature.
1.5 Council's concurrence with the Committee of Adjustment
decision is required in order to afford Staff's official
status before the Ontario Municipal Board in the event of an
appeal of the decision of the Committee of Adjustment.
