A. STRIKE TO WAIVE CONDITIONS OF APPROVAL LD 764/86 (SWALLOW) , RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 273 -89 be received; 2. THAT Mr. Strike be advised that Council is not prepared to waive the conditions of approval related to the Swallow's consent applications save and except Conditions, 5, 6 and 7 as contained in Planning Staff comment dated August 17, 1989 to the Durham Land Division Committee. 1. BACKGROUND: 1.1 On October 23, 1989, Mr. A. Strike appeared before the General Purpose and Administration Committee requesting Committee and Council to waive several conditions of approval as detailed by Staff in relation to consent applications submitted by Mr. Swallow. 1.2 The main argument advanced by Mr. Strike is that the Swallow's property was originally under separate deeds and subsequently, melded together as a result of the Planning Act. ...2 2 . COMMENTS: 2.1 The conditions of approval recommended by Staff are reflections of policies and by -laws adopted by Council from time to time. They are standard requirements applicable to all consent applications irrespective of past circumstances. The basic philosophy is that, where a lot is being created, there will be an additional family living in the Town and this same family will require the many Town's services, and hence, the requirements of lot levy and parkland dedication. 2.2 The subject property fronts on Bloor Street which is a designated arterial road in the Official Plan. As a result, the Town's standard condition requires dedication of land for road widening purposes. In addition, the Town's policies requires contribution to upgrade an existing road due to the fact that development of the property will contribute to the wear and tear of the existing road. 2.3 Staff from Public Works, Community Services, and Planning Departments have reviewed this matter jointly and in consideration of the above comments, we are of the opinion that all conditions shall stay save and except Conditions 5, 6, and 7 contained in Mr. Pellarin's letter of August 17, 1989 to the Durham Regional Land Division Committee. These conditions pertain to drainage, and the Public Works Staff are satisfied that, given the size of the parcel, that conditions pertaining to drainage may be too onerous.
