TOWN OF NEWCASTLE REPORT File # 16 Res. # By -Law # MEETING: General Purpose and Administration Committee DATE: Monday, October 23, 1989 REPORT #: PD- 271 -89 FILE #: PLN. 5.2 SUBJECT: BY -LAW ENFORCEMENT MONTHLY REPORT FOR SEPTEMBER 1989 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 271 -89 be received for information. -------------------------------------------------------------------------- - - - - -- 1119�iil 1.1 The attached chart indicates statistical information pertaining to By -law Enforcement activities for the month of September and is provided herein for the information of Committee and Council. 1.2 The following cases were heard on 19 September 1989 before a circuit Justice of the Peace; a) Mr. Richard Meiger, 58011 Main Street, Orono (File: 101.89.5e) was charged under Zoning By -law 84 -63 Section 3.14(f) for parking and storing a commercial motor vehicle on residential property. He was found guilty by the Court. ...2 599 78 REPORT NO: PD- 271 -89 PAGE 2 b) Mr. Mel Hartwig, R.R. #2, Orono (File: 10.13.183) was charged under Zoning By -law 84 -63, Secton 3.14(f) for parking and storing a commercial motor vehicle on residential property. A verdict of guilty was rendered. c) Wladslaw & Teresa O'Konski, R.R. #1, Hampton (File 10.13.233) were charged under Zoning By -law 84 -63, Section 6 and two charges were laid pursuant to Noise By -law 87 -131 (Section (1). A verdict of guilty was rendered. d) Donna Stokes Cormack, 96 Foxhunt Trail (File 10.13.253) Bowmanville, was charged under Zoning By -law 84 -63, Section 3.14(f) and was found guilty. e) Abek Real Estate Corp., 430 King St. E., Newcastle; two charges pursuant to the Ontario Building Code, Section 5 (build without a permit). The company was found guilty. f) A noise by -law charge was dismissed due to errors found in the by -law. Staff has prepared a new by -law to replace the out -dated by -law 87 -131. g) Oshawa Motorcycle Club (File 10.13.131) was charged under Zoning By -law 84 -63, Section 25 1(b). This matter was adjourned "sine die" without assigning a day for trial. The "club" is aware that a study must be conducted pursuant to the Environmental Protection Act, prior to any further action being taken by the Town. Their use has ceased, and they have no intention of using the facilities until all studies are completed. Staff will monitor the activities if violations are noted, appropriate action will be taken.
