HomeMy WebLinkAboutPD-255-89V TOWN OF NEWCASTLE REPORT File# 7 BARATZ Res. # By -Law # MEETING: General Purpose and Administration Committee DATE: Monday, October 23, 19 8 9 REPORT #: PD -255 -89 FILE #: DEV 89 -75 (R -REF: OPA 89 -69/N) SUBJECT: REZONING /SITE PLAN APPROVAL /OFFICIAL PLAN AMENDMENT PART LOT 10, CONC. 1, FORMER TOWN OF BOWMANVILLE MICHAEL BARATZ RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 255 -89 be received; and 2. THAT Application for Amendment to the Town of Newcastle Comprehensive Zoning By -law 84 -63, as amended, submitted by Michael Baratz on behalf of United Counties Holdings Ltd., be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3. THAT the persons listed to be notified be informed of Council's decision; 1. BACKGROUND 1.1 On June 15, 1989 the Town of Newcastle Planning Staff received an application for site plan approval in conjunction with an application to amend the Town of Newcastle Comprehensive Zoning By -law 84 -63, as amended. The application was submitted by Michael Baratz on behalf of United Counties Holdings Ltd. ...2 REPORT NO.: PD-255-89 PAGE 2 1.2 The proposed Zoning By -law Amendment would change the zone category of a 1023.3 m 2 parcel of land at the south west corner of Lambert and Church Street in Bowmanville from "Urban Residential Type One (R1)" zone to an appropriate zone in order to permit the dvelopment of a parking lot which is to be developed in conjunction with a proposed office building to be located at the north west corner of King and lambert Streets in Bowmanville. 1.3 On June 29, 1989, the Planning Department received notification that an application to amend the Town of Newcastle Official Plan was submitted to Durham Region Planning Department. 1.4 The proposed Official Plan Amendment would change the designation of the suL ,.:r: property from "Low Density Residential" to "Commercial" use to permit the development of a Parking Lot for the adjoining proposed office building. 2. PUBLIC NOTICE AND SUBMISSIONS 2.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. As of the writing of this report, no written submissions have been received. 3. AGENCY COMMENTS 3.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following department /agencies in providing ...3 • • • 1 • , .. • PAGE comments, offered no objection to the application as filed: - Newcastle Fire Department - Newcastle Hydro Electric Commission - Ministry of Transportation 3.2 The Town of Newcastle Community Services has no objection to the application, however they do request that a 2% land dedication requirement for parkland be accepted as cash -in- lieu of parkland. 3.3 Town of Newcastle Public Works Department requested that the applicant will have to provide for a 2.38 metre road widening with 0.3 metre reserve and sight triangles be dedicated to the town, will bear the costs (100 %) of any works on Church and Lambert Streets that are necessitated as a result of this development. It was also noted that an entrance way will not be permitted on Church Street, and that the applicant shall submit a lot grading plan and a Storm Water Management Plan. 3.4 The Durham Region Planning Department requested that the amending by -law not be passed until the Official Plan Amendment has been dealt with by Town Council and Region Council. However, if the amending by -law is passed, the Region requests that the by -law not come into effect until the related Official Plan Amendment has been approved by the Minister of Municipal Affairs pursuant to Section 24(2) of the Planning Act. 5.5 Comments remain outstanding from the following agencies: - Durham Region Works Department - Northumberland and Newcastle Board of Education ...4 REPORT NO PD-255-89 PAGE 4 6.1 As the purpose of this report is to address the requirement of a Public Meeting under the Planning Act and in consideration of the agency comments outstanding, it is recommended that the application be referred back to Staff for further processing.
