THAT Report PD- 254 -89 be received; 2. THAT the revised proposed Plan of Subdivision 18T- 760121 dateJFebruary 21, 1989 as per attachment No. 1, be Approved subject to the conditions contained in this Report; 3. THAT the Mayor and Clerk be authorized, by by -law, to execute a Subdivision Agreement between the applicant /owner and the Corporation of the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and Director of Planning; and 4. THAT a copy of Report PD- 254 -89 and Committee and Council's recommendation be forwarded to the Ministry of Housing; the Regional Planning Department and al]. interested parties attached hereto. ...2 599 44 REPORT NO.: PD-254-89 PAGE 2 1.1 on October 20, 1976, the Ministry of Housing circulated a proposed Plan of Subdivision under file Number 18T-76021 to the Town of Newcastle for comment. The subject lands comprised of a 3.0 hectare parcel of land on the south east corner of Baldwin and Clarke Street located in Part Lot 28, Concession 1, former Township of Clarke. The application originally proposed 30 single family dwelling units on the above-noted property. The plan underwent a number of changes prior to finally receiving Draft Approval for twenty-one (21) single family dwelling lots on June 30, 1980. Draft approval has since been extended by the Ministry several times and the latest extension of Draft Approval would lapse on December 30, 1989. 1.2 In August, 1989, Planning Staff received a request for comments on a revised Plan of Subdivision for the subject land. The revised proposal has reduced the number of units by one (1) to twenty (20). It is also noted that the land has changed ownership and is now owned by Iona Corporation. The proposed lot sizes would comply with the requirements of the Town's Comprehensive Zoning By-law 84-63, as amended. Planning Staff undertook a limited circulation in order to obtain additional comments, if any, on the revised plan. 1.3 The Town's standards and policies with regards to subdivision approval has changed significantly since 1980. Therefore, rather than amending the previous conditions of approval, the Town's present standard conditions of approval, in addition to any site specific conditions, will be applied. 1.4 In consideration of the above-noted comments and comments received from the Town's Public Works Department Staff, it is respectfully recommended that the subject revised Plan of Subdivision be recommended for approval, subject to the revised Conditions of Approval as attached hereto. ...3 599 45 REPORT 0O.: PD-254-89 _______________________ Respectfully submitted, Development CP*EW+cc *Attach. That this approval applies to draft Plan of Subdivision 18T-76021, prepared by Kanton Kikas Limited, dated February 21, 1989, showing Lots 1 to 20 inclusive for single family detached dwellings, and Block 21 for road widening and site triangle. FINAL PLAN REQUIREMENTS 2. That all streets within the Plan of Subdivision shall be dedicated as public highway and shown as such on the final plan. 3. That all streets shall be named to the satisfaction of the Town of Newcastle and shown on the final plan. REQUIREMENTS TO BE SATISFIED PRIOR TO SUBDIVISION AGREEMENT 4. That the owner shall retain a qualified landscape architect to prepare and submit a Landscaping Plan to the Director of Public Works and the Director of Planning and Development for review and approval. The Landscaping Plan shall reflect the design criteria of the Town as amended from time to time. 5. That the Applicant/owner submit approval from the Ganaraska Conservation Authority and the Town of Newcastle, for the location and design of the 'future road' to service the lands south-west of the subject lands, also owned by applicant. 6. That the owner shall retain a professional engineer to prepare and submit a Master Drainage and Lot Grading Plan to the Director of Public Works for review and approval. All plans and drawings must conform to the Town's Design Criteria as amended from time to time. ...2 - 2 - 7. REQUIREMENTS TO BE INCLUDED IN SUBDIVISION AGREEMENT 8. That the Owner shall enter into a Subdivision Agreement with the Town and agree to abide by all terms and conditions of the Town's standard subdivision agreement, including, but not limited to, the requirements that follow. 9. That all easements, road widening, and reserves as required by the encumbrances. Town shall be granted to the Town free and clear of all 10. That the Owner shall pay to the Town at the time ot execution ot the subdivision agreement, five percent (5%) cash-in-lieu of parkland dedication for residential development and two percent (2%) for commercial and industrial development. 11. That the Owner shall pay to the Town, at the time of execution of the Subdivision Agreement' development charge levy and any other charges in effect at the time of execution and further agrees to abide by the Town's payment schedule as amended from time to time. 12. That the Owner shall provide and install sidewalks, street lights' temporary turning circles etc. as per the Town's standards and criteria. 13. That the Owner shall provide the Town, at the time of execution of the subdivision agreement, Letters of Credit acceptable to the Town's Treasurer, with respect to Performance Guarantee, Maintenance Guarantee, Occupancy Deposit and other guarantees or deposit as may be required by the Town. 15. That prior to the issuance of building permits, access routes to the subdivision must be provided to meet Subsection 3.2.5.2(6) of the Ontario Building Code and, that all watermains and hydrants are fully serviced and the Owner agrees that during construction, .fire access routes be maintained according to Subsection 2.5.1.2 of the Ontario Fire Code, storage of combustible waste be maintained as per Subsection 2.4.1.1 and open burning as per Subsection 2.6.3.4 of the Ontario Fire Code. 16. That a traffic study be prepared reviewing the existing traffic travelling through the existing C.N.R. overpass and addressing the impact of the proposed development on these conditions. 17. That a storm water management plan be prepared for the watershed as a whole and submitted for review and approval by the Director of Public Works. 18. That storm sewers be provided for all lots internal and external to Street 'A' including Lots 1, 2, 3 and 12. 19. That the applicant reconstruct Baldwin and Clarke Streets to Town of Newcastle Urban Standards as follows: a) Baldwin Street from Clarke southerly to south limit proposed Lot 20. b) Clarke Stret from Baldwin Street, including intersection, easterly to Mill Street. �� /y 4I ...4 - 4 - Further to the above, the Town would endeavour to collect on behalf of the developer 1/2 half of road and storm sewers costs from future developers who abut the required reconstruction. 20. That the developer make contribution to the future upgrading of Mill Street, including the C.N.R. overpass according to Town Policy. This contribution shall be determined, based on total areas of developable and developing lands that will directly impact the use of this collector corridor. 21. That the developer upgrade existing streetlighting on Clarke and Baldwin Streets to Town Standards as well as provide for streetlighting of Street 'A'. 22.
