SUB,JECT: BY -LAWS TO APPOINT BUILDING AND PLUMBING INSPECTORS
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-250-89 be received;
2. THAT the attached By-laws appointing Building and Plumbing Inspectors
be received.
1. BACKGROUND:
1.1 Pursuant to the requirements of the Building Code Act, the Council of a
-municipality is responsible for the enforcement of the Building Code within
the municipality. Further, the Act requires that Council appoint Building
Inspectors as are necessary for enforcement.
.By-law 76-23 as amended appoints inspectors as required, however, this By-law
is out of date and should be amended. In addition, By-law 76-23 as amended
appoints the Plumbing Inspector although the authorative legislation is the
Ontario Water Resources Act which provides that the Council of a municipality
may pass by-laws for the appointing of Plumbing Inspectors.

2.1 In order to recognize staff changes and have the PIuobiug Inspectors legally
appointed, Staff have prepared 2 for the appointment of Building and
Plumbing Inspectors and hereby recommend their approval to Council.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY -LAW NUMBER 89-
being a By -law respecting the appointment of a Chief Building Official and
Building Inspectors.
WHEREAS subsection 2 of Section 3 of the Building Code Act, R.S.O., 1980,
Chapter 51, empowers Council to pass certain by -laws respecting the
appointment of a Chief Building official and Building Inspectors.
NOW THEREFORE The Corporation of the Town of Newcastle enacts as follows:
1) The person shown on Schedule "A" to this By -law is
hereby appointed as Chief Building Official for the
Town of Newcastle.
2) The persons listed on Schedule "B" to this By -law are
hereby appointed as Building Inspectors for the Town
of Newcastle.
3) The person shown on Schedule "C" to this By -law is
hereby appointed an Inspector for the purpose of
receiving plans and performing inspections related
to fire access routes, fire alarms, fire detections
and suppression systems as may be required under the
Building Code Act, 1974 and the Regulations thereto.
4) By -law 76 -23, as amended, is hereby repealed.
This By -law shall come into effect on the date of passing hereof.

BY -LAW NUMBER 89-
being a By -law respecting the appointment of Plumbing Inspectors.
WHEREAS subsection 1(a) of Section 46 of the Ontario Water Resources Act
R.S.O., 1980 Chapter 361, empowers Council to pass certain by -laws
respecting the appointing of Plumbing Inspectors.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
The persons listed on Schedule "A" to this By -law
are hereby appointed as Plumbing Inspectors for
the Town of Newcastle.
This By -law shall come into effect on the date of passing hereof.
