SUBJECT: AMENDMENT NO. 40 TO THE VICTORIA COUNTY OFFICIAL PLAN
RURAL INDUSTRIAL POLICIES

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Commmittee recommend to Council the following:
1. THAT Report PD- 248 -89 be received; and
2. THAT the Ministry of Municipal Affairs, the County of Victoria and the
Region of Durham be advised that the Town of Newcastle objects to the
approval of Amendment No. 40 to the Victoria County Official Plan until
such time as modifications are made to satisfy the Town's concerns; and
3. THAT a copy of Report PD- 248 -89 be forwarded to the Ministry of Municipal
Affairs, the County of Victoria and the Region of Durham.
1. BACKGROUND
1.1 On May 24, 1989, the Town received a request for preliminary comments
for a proposed amendment to the Victoria County Official Plan, regarding
industrial development in rural Townships. The amendment has two
components:
(i) Within the predominately agricultural land base townships of
Victoria County, rural industrial development will be encouraged in
industrial parks so as to concentrate those uses; therefore
minimizing the impact on agricultural areas and to centralize uses
in close proximity to major transportation routes and services.

addition to industrial parks in Townships where agricultural uses
are not predominant. A home industry must be dry, non - hazardous and
non - obnoxious in nature such as woodworking, cabinet - making, building
contractors, welding shops, repair shops and well drillers.
1.2 In response Staff had suggested that the policy indicated that the
preferred location for such parks would be within hamlets so as to
reinforce the service role of the hamlets. Furthermore, Staff had
suggested that the industrial parks be limited in number and size, that
they shall not conflict with predominant agricultural uses and they
should not be located on or near environmentally sensitive lands.
1.3 The Region of Durham was also circulated a copy of the proposed
amendment. In its report to Planning Committee, dated June 20, 1989
Regional Staff noted the proposed amendment was significantly different
from the thrust of the policies in the Durham Region Official Plan. In
the Regional Official Plan, industrial areas are designated within the
urban areas to accomodate industrial development within the Region. The
Durham Region Official Plan discourages industrial development in rural
areas. However, through the review of the Durham Region Official Plan,
it has been proposed that limited rural industrial parks may be permitted
in the Oak Ridges Moraine of the Major Open Space. The Town of
Newcastle has stated its opposition to such a policy.
1.4 On July 7, 1989, the Town received notice that the County of Victoria
had submitted the Amendment to Ministry of Municipal Affairs for
approval. To shorten the approval process however, the County of
Victoria has circulated the amendment, on behalf of the Ministry, and
requested that the Town forward its comments directly to the Ministry.
2. STAFF COMMENTS
2.1 Victoria County bounds the Region of Durham to the north of the former
Township of Clarke and to the east of the northern portion of the former
Township of Darlington in the Town of Newcastle. The nearest hamlet to
Newcastle would be Pontypool, located on Highway 35.

2.2 Rural Industrial Parks
The proposed amendment is "permissive" allowing Townships to identify
industrial parks subject to the following conditions®
(i) they "should be directed" to low potential agricultural lands
(ii) they are in close proximity to Highways and County Roads
(iii) they are compatible to surrounding land uses.
The amendment itself does not identify specific areas through a
designation in the Official Plan.
Staff are concerned that the amendment does not provide for a rigorous
review of the site specific locations for proposed industrial parks. As
one example that would directly impact the Town, rehabilitated gravel
pits along Regional Road # 20 would be a prime location for such
industrial development particularly in light of improvements to Highways
35/115 and the proposed Highway 407. The amendment does not provide a
rigorous review of the environmental impacts. There would be no
limitation on the amount of land which could be zoned for industrial
purposes. There would be no amendment to the Official Plan required.
Furthermore, there is no encouragement to locate such uses in hamlets.
The Town has expressed its opposition to any policy provision to permit
industrial uses in the Oak Ridges Moraine within the Durham Region
Official Plan. It is Staff's view that Amendment # 40 to the Victoria
County Official Plan could result in similiar development just across
the Town's municipal boundary. As a result, Staff recommend that the
Town register its opposition to the provisions of Amendment # 40 related
to rural industrial parks.
2.3 Home Industries
The second portion of the amendment is specific to allowing home
industries. A home industry has been defined as one that is generally
operated and owned by the individual who resides on the same lot, and the
uses are limited to those mentioned above. The policies further indicate
that the use shall be located on a lot larger in size than that required

use. The policies do not specify whether the use can take place only on
existing lot of record or whether lots can be created by consent for such
uses. This is contrary to the intent of the rural land use policies
generally restricting lot creation in the rural areas. It is recommended
that home industries be restricted to "existing lots of record".
3. CONCLUSION
3.1 Staff recognize the importance of industries locating within growing
municipalities and the difficulties of agricultural land-based rural
townships have in attracting industrial development. At the same time,
it must be recognized that rural industrial development can have negative
impacts on the environment and the agricultural community. What Victoria
County is attempting to do to open up industrial opportunities in the rural
areas, particularly those areas abutting the Town of Newcastle is contrary to
the Town's existing position in curtailing industrial development in and
around the Oak Ridges Moraine.
It is recommended that the Town advise the Ministry of Municipal Affairs
that it is opposed to the approval of Amendment No. 40 to the Victoria
County official Plan until such time as modifications can be made to
satisfy the concerns outlined in this report.

IINOTICE OF ADOPTION OF AN OFFICIAL PLAN AMENDMENT BY THE COUNTY OF
VICTORIA
TAKE NOTICE that the Council of the Corporation of the County of
Victoria adopted Amendment No. 40 to the Victoria County Official
Plan on the 22nd day of June, 1989, pursuant to Section 21 of the
Planning Act, S.O. 1983. The Amendment will be forwarded to the
Ministry of Municipal Affairs for approval.
The Amendment is to amend the basis, growth strategy, goals and
objectives, general policies and Industrial Designation policies
within the Official Plan to encourage and permit industrial
development in the rural areas of the County.

A. BASIS
Victoria County Council. wishes to encourage industrial

B. PURPOSE
The purpose of the Ariendirent is to establish new
policies within the Official Plan to allow for
industrial uses to locate in the rural Townships.
Within the predominately agricultural land base
Townships, rural industrial development will be
encouraged in Industrial parks so as to group the uses
thus minimizing the ir•jpact: on the agricultural area and
to centralize similar type uses in close proximity to
major roads and services. In the Townships in which
agriculture is not a predominant land use, then home
industries will be permitted in addition to industrial
parks.
C. ACTUAL AMENDMENT
The approved Victoria County Official Plan be amended as
follows:
1. Section 4.1 "Growth Strategy" be amended by adding
the following paragraph at the end of the existing
section:
"The Townships will be encouraged to develop dry
type industrial parks for uses that do not require
full municipal services. In Townships that have a
predominately agricultural land base, the
Industrial Parks should be directed to low
potential agricultural land's. Such parks should be
in close proximity to County Roads, Provincial
Highways or local arterial roads. In Townships
which have a limited agricultural land base, home
industries will be encouraged. In all instances,
the industries must be compatible with the
surrounding lands uses."
2. Amend the "Industry Objectives" by adding the
following:
"4.11.11.5 To encourage rural limited service
dry industrial uses to locate in
:industrial parks within Townships. !
11.4.11.6 To encourage home industries in the
non- agricultural land base j

D. BACKGROUND
The Amendment is to allow for industrial development to
locate in the rural areas. The Amendment changes
policies within the growth strategies and goals and
object,'ve:: to promote rural industrial development. A

for home industry uses.' Many of the uses presently
If exist in the Rural designation. The policy recognizes
these uses as permitted uses. The local Municipalities
can then encourage industrial development. It is
recognized that this Amendment alone will not be all
that is required to promote industrial development in
the rural area. In the areas that are presently
designated as Agricultural, prior to the establishment
I of an industrial park, it will be necessary to amend the
Official Plan to designate the land Industrial. As part
of that process, the County is undertaking a study to
determine the most appropriate locations for industrial
parks.
