THAT Report PD- 242 -89 be received; 2. THAT the attached Bylaw detailing the fee schedule for various types of Planning and Development applications, be APPROVED. 1. BACKGROUND: 1.1 The current fee schedule for various development applications was last updated on July 1, 1988. Considerable time has lapsed since and it is prudent to revise the fee structure in time for the preparation of the 1990 Budget. 1.2 Section 68 of the Planning Act allows the municipality to pass a by --law to set out the fee structure for development applications to offset the anticipated cost to the municipality in processing each type of application. ...2 E- '7 REPORT NO.: PD-242-89 PAGE 2 2. COMMENTS: 2.1 The "anticipated cost" in processing each type of application is not defined in the Planning Act. However, most municipalities generally have taken the approach to mean all costs excluding staff time. These costs include postage, notices, stationary, photocopying, courier, site inspection travel, phone, fax and other miscellaneous office overhead. Staff have reviewed the process involved with each type of application, taken into account of the frequencies of having to serve notices, hold public meetings, conducting various follow-up, circulation of application, etc. and arrive at an average cost for each type of application. These costs are provided in the chart that follows. 2.2 In addition to setting out the fee structure, Staff also recommend that an additional fee of $10,000. be imposed for those applications that involve review and assessment under either the Environmental Protection Act or the Environmental Assessment Act. This additional application fee is to enable the municipality to recover part of its costs in retaining professional consultant to review technical reports submitted by the applicant. 3. THE PROPOSED FEE STRUCTURE 3.1 The table below indicates the proposed fee structure for each type of planning and development application. Current rates are provided herein for comparison purposes. WHEREAS Section 68, Subsection 1 of the Planning Act, 1983, provides that by -laws may be passed by the Council of a Municipality to prescribe a tariff of fees for the processing of applications made in respect of planning matters; i AND WHEREAS Council deems it necessary to prescribe a Fee Schedule to meet the � anticipated cost to the Municipality in respect of the p p y p processing of each type of application provided for in the Schedule of Fees; NOW THEREFORE, the Council of the Corporation of the Town of Newcastle, pursuant to Section 68, Subsection 1 of the Planning Act, 1983, enacts as follows: 1. The following Fee Schedule shall apply for the specified applications submitted in respect of the followings: A. Rezoning Application a) to implement Official Plan Amendment & Subdivision $1,000. b) to implement Official Plan Amendment only 800. c) with Site Plan approval 600. d) rezoning only 400. B. Site Plan Approval Application a) agreement required 400. b) plans only 200. c) amendment to agreement /plans 200. C. Neighbourhood Plan Amendment Application 400. D. Minor Variance Application 100. E. Subdivision Agreement Clearance Letter 30. F. Zoning Clearance Letter 30. G. Application to remove Part Lot Control 200. .t - 2 - H. Miscellaneous Clearance Letters $ 30. (including outstanding work orders, building compliance, property standards etc.) 1. Application involves review under $10,000. E.P.A. and /or E.A.A. process (additional fee) 2. For the purpose of Paragraph 1, all reference to plan of subdivision includes plan of condominium. 3. All fees are non - refundable after seven (7) days of submission. At any time, if an application is deemed not necessary by the Director of Planning and Development, the fee shall be refunded to the applicant. 4. By -law 88 -81 is hereby repealed. 5. This by -law shall come into force and take effect on the date of passing hereof.
