SUBJECT: REPEAL OF INTERIM CONTROL BY-LAW
NO. 88-197
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-229-89 be received;
2. THAT the attached By-law repealing By-law 88-197 be approved; and
3. THAT the Ontario Municipal Board, the Region of Durham Planning Department, and
Kathryn Harrison of Jones and Jones and those on the circulation list of By-law
88-197 be so advised of Council's decision and a copy of the Repealing By-law
be forwarded to same.
1. BACKGROUND:
1.1 on December 19, 1988, Council passed Interim Control By-law 88-197 to
prohibit the mooring of watercraft in excess of 60 feet in length and which
is not self-propelled. This prohibits mooring or docking of unsightly large
dredging barges within the Bowmanville Harbour for a period of one (1) year
to expire on December 19, 1989.

1.2 Subsequent to its passage of the By-law, the Port Darlington Harbour
Company lodged an appeal to the Ontario Municipal Board. A Hearing date
has not been set.
1.3 The By-law has served the purpose since its enactment. Dredging of the
Harbour is near completion and there is no evidence of any potential
mooring of unsighted dredging barge within the Harbour. Notwithstanding
the By-law will expire on December 19, 1989, Staff is of the opinion
that the current By-law be repealed now to avoid the unnecessary
hearing.

BY -LAW NUMBER 89-
being a By -law to repeal Interim Control By -law 88 -197
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
no longer necessary to impose an interim control by -law for the Bowmanville
Urban Area.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. By -law 88 -197 is hereby repealed.
z. This Repealing By -law shall come into effect on the date of passing
hereof.

BY -LAW read a second time this day of 1989
BY -LAW read a third time and finally passed this day of
1989.

EXPLANATION AS TO PURPOSE AND EFFECT OF
BY -LAW NO. 89-
The Purpose and Effect of this By -law is to repeal By -law 88 -197 which
prohibited the use of land, and land under water, buildings, or structures
within the affected area generally described as the Bowmanville Harbour for any
purpose other than one for which it was lawfully used on September 12, 1988.
As an exception, self- propelled recreational small crafts may be permitted to
be located, moored, or stored in the harbour area.
