HomeMy WebLinkAboutPD-227-89DNo 812518 TOWN OF NEWCASTLE REPORT File #44 -'11., Res® # By -Law MEETING: General Purpose and Administration Committee DATE: Monday, September 18, 1989 ROUT #: PD- 227 -89 FILE #: 18T -81008 StJ&JECT: PROPOSED PLAN OF SUBDIVISION - 812518 ONTARIO LIMITED PART LOT 29, CONCESSION 2, FORMER TOWNSHIP OF CLARKE SUBDIVISION AGREEMENT - AUTHORIZING BY -LAW RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 270 -88 be lifted from the table; 2. THAT Report PD- 227 -89, be received; and 3. THAT the Mayor and Clerk be authorized, by by -law, to execute a Subdivision Agreement between the applicant /owner and the Corporation of the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and Director of Planning. 1. BACKGROUND 1.1 The above -noted Plan of Subdivision, as previously considered by Committee and Council received draft approval on March 29, 1983. Amongst the conditions of draft approval was the requirement that the Owner agree, in writing, to satisfy all the requirements, financially and otherwise. 580 REPORT NO.: PAD- 227_89 PAGE 2 -----------------.-----------_-------------------------------------------------- 1.2 The Owner of the subject lands, through their Consulting Engineers, G. M. Sernas and Associates, have requested that an authorizing by -law be approved. 1.3 Staff Report PD- 170 -88, recommending the passing of an authorizing by -law was tabled by Committee and Council, pending the resolution of the status of Given Road. 1.4 Staff Report WD- 51 -89, in response to the tabling motion, reviewed the proposed subdivision and determined that the proposal to close Given Road, as suggested by the Owner, was not in the best interest of the Town. Furthermore, upon discussion with the Ministry of Transportation Staff, an alternative proposal was prepared that satisfied Public Works Department concerns. 1.5 The proposal requiring the reconstruction of Given Road and Highway No. 2 intersection was subsequently included within the draft conditions of approval. 1.6 The recommendation within Staff Report WD- 51 -89, was that it be received for information; and that a copy of this report be forwarded to the residents of Given Road. 2. STAFF COMMENTS 2.1 In consideration of the above, and in order to facilitate execution of the Agreeement, an Authorizing By -law as attached hereto, is submitted for Committee's information and consideration. Recommended for presentation to the Committee Lawren rAdin otseff C hief trative Officer DN: 812518 THE CORPORATION OF THE TOWN OF NEWCASTLE BY -LAW NUMBER 89- being a By -law to authorize the entering into an Agreement with 812518 Ontario Limited and the Corporation of the Town of Newcastle for the development of Plan of Subdivision 18T- 81008. The Council of the Corporation of the Town of Newcastle hereby enacts as follows: 1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation's seal, an Agreement between 812518 Ontario Limited and the said Corporation dated the day of , 1989, in the form attached hereto as Schedule "An 2. THAT the Mayor and Clerk are hereby authorized to accept, on behalf of the Town, the said conveyances of lands required pursuant to the aforesaid Agreement. 3. THAT Schedule "A" attached hereto forms part of this By -law.
