THAT Report PSD-063-04 be received; and 2. THAT Council concurs with the decision of the Committee of Adjustment made on May 20,2004 for applications A2004/013, A2004/014, A2004/015, and A2004/016 and that Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment. The purpose of the minor variance application and the Committee's decisions are detailed in Attachment 1. The decisions of the Committee are detailed below. Application Number Staff Recommendation Decision of Committee A2004/013 Approve Approved A2004/014 Approve Approved A2004/015 Table Tabled A2004/016 Approve Approved DECISIONS OF COMMITTEE OF ADJUSTMENT FOR MAY 20,2004 2.0 COMMENTS A2004/013 was to reduce the minimum required setback for a non farm related building from an existing agricultural building from 300 metres to 150 meters to permit the construction of a single detached dwelling on a farmer's retirement lot. Staff recommended that the application be approved and the Committee concurred. A2004/014 was to reduce the minimum lot area from 4,000 m2 to 3,066 m2 to permit the melding of a property through land severance. Staff recommended that the application be approved and the Committee concurred. A2004/015 was an application to permit the reduction of the 7.5 metre rear yard setback for an unenclosed deck which is permitted to project into the rear yard 1.5 metres for a setback of 6.0 metres. The applicant was unable to arrange a time for staff to visit the subject property prior to the meeting. The application was tabled until the June 10, 2004 meeting to provide staff and the members of the Committee of Adjustment with an opportunity to visit the subject property. A2004/016 was to reduce the required minimum driveway width for two-way traffic from 6.0 metres to 3.0 metres with the exception of the first 6.0 metres from the street to allow the establishment of a commercial dog kennel. Staff recommended that the application be approved and the Committee concurred 634 REPORT NO.: PSD-063-o4 PAGE 3 Staff has reviewed the Committee's decisions and is satisfied that the applications that received approval are in conformity with the Official Plan policies, consistent with the intent of the Zoning By-law and are minor in nature and desirable. Council's concurrence with the Committee of Adjustment decisions is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of any decision of the Committee of Adjustment.
