AMIUMINTIMM REPORT File #66 -., Res. # By-Law # MEETING: General Purpose and Administration Committee DATE: Monday, September 18, 1989 REPORT #: PD-224-89 FILE #: DEV 88-133 SLRECT: REZONING APPLICATION - BRUCE AND PAMELA WELSH PART LOT 35, CONCESSION 2, FORMER TOWNSHIP'OF DARLINGTON FILE: DEV 88-133 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-224-89 be received; 2. THAT Rezoning Application DEV 88-133 submitted by Bruce and Pamela Welsh to permit the creation of one single family residential lot be APPROVED; 3. THAT the by-law to amend By-law 84-63 attached hereto be forwarded to Council for approval; 4. THAT the Region of Durham and Mr. & Mrs. Welsh be so advised and forwarded a copy of Report PD-224-89; and 5. THAT the delegations and persons listed to be notified be informed of Council's decision. 1. BACKGROUND: 1.1 The subject rezoning application seeks to permit the creation of one residential lot for the construction of one single family dwelling. P_ / A )614 ...2 REPORT NO.: PD-224-89 1.2 The subject property is located on the west side of Varcoe Road, north of Nash Road, being Part Lot 35, Concession 3, former Township of Darlington, and more specifically defined as Parts 2 & 3, Plan 10R-722 (see Attachment No. 1). The municipal address is 98 Varcoe Road. 1.3 A single family dwelling is located on the southern portion of Part 3. Part 2 is a 20m wide right-of-way accessing a landlocked property to the rear of the subject lands occupied by a house. Surrounding land uses are as follows: large lot single family residential to the north and south, residential plan of subdivision 10M-787 to the east, and residential and vacant lands to the west. 2. OFFICIAL PLAN AND ZONING BY-LAW: 2.1 The subject lands are designated "Residential" by the Region of Durham Official Plan and the Town of Newcastle official Plan. The lands are located in the Courtice West Neighbourhood. Staff have finalized a draft Neighbourhood Development Plan for the area west of Varcoe Road north of Nash Road. The Public Meeting for the proposed Neighbourhood Development Plan is scheduled for the General Purpose and Administration Committee meeting of October 2, 1989. Notice of the Public Meeting has been sent to area residents and adjacent land owners. The local road as proposed by the Neighbourhood Plan which runs westerly from Varcoe Road would be located on the northern portion of the subject lands currently occupied by the right-of-way (i.e. Part 2, Plan 10R-722). The proposed new lot would not interfere with the development of the surrounding lands in conformity with the Neighbourhood Development Plan. 2.2 The subject lands are zoned "Agricultural (A)" by By-law 84-63, the Town of Newcastle Comprehensive zoning By-law. REPORT NO.: PD-224-89 The proposed new lot would have a frontage of 17m and an area of 936 square metres. This conforms to the requirements of the "Urban Residential Type one (Rl)" zone with respect to exterior lots. The balance of the subject lands would also conform to the "R111 zone requirements in regards to lot frontage and area, and the new interior sideyard of the existing single family dwelling. 2.3 The proposed new lot would not affect the use of the right-of-way to access the land-locked parcel to the rear of the subject lands. 3. PUBLIC MEETING: 3.1 The Public Meeting for the subject rezoning application required pursuant to Section 34 of the Planning Act was held on March 20, 1989. Staff Report PD-75-89 noted the need to finalize the details of the Neighbourhood Development Plan prior to a decision being made with respect to the rezoning application. Council resolved to refer the application back to Staff for further processing. 4. AGENCY COMMENTS: 4.1 In response to the circulation of the rezoning application, the following agencies indicated no objection: - Town of Newcastle Fire Department - Region of Durham Health Unit - Region of Durham Planning Department 4.2 The Town of Newcastle Public Works Department offered no objection to the proposal however, requested that a 0.3 metre reserve and 6 metre by 10 metre sight triangle be dedicated to the Town on the north-east corner of the proposed lot. The applicant is also required to provide a cash contribution for the endeavouring to collect clause for the M ,566` REPORT NO.: PD-224-89 construction of Varcoe Road by Schleiss and Holland. in addition, a lot grading plan be provided, satisfactory to the Director of Public Works. The Department has also indicated no objection to the proposed road pattern in preliminary comments on the Neighbourhood Development Plan. 4.3 The Town of Newcastle Community Services Department requested 5% cash- in-lieu of parkland dedication for the proposed lot. 4.4 The Region of Durham Public Works Department offered no objection to the creation of the lot, noting that municipal water and sanitary sewer services are available to the subject property from Varcoe Road. 4.5 Formal comments on the application have not yet been received from the Central Lake Ontario Conservation Authority. However, Authority staff have verbally indicated no objection to the creation of the proposed new lot. 5. PUBLIC SUBMISSIONS: 5.1 No public submissions have been received in respect of the subject application. 6. STAFF COMMENTS: 6.1 In reviewing the subject application, Staff note that none of the circulated agencies indicated an objection to the principle of creating the proposed new lot. The specific requirements of the Public Works Department and the Community Services Department can be addressed through the related severance application. 6.2 Staff further note that the proposed new lot and the balance of the subject lands would conform to the requirements of the "Rl" zone. As well, development of the lot would be in keeping with the intent of the draft Neighbourhood Development Plan for this area. REPORT NO.: PD-224-89 ----------------------- 7. RECOMMENDATIONS: PACE 5 ----------------------- 7.1 it is therefore recommended that Rezoning Application DEV 88-133 be APPROVED and the by-law to amend By-law 84-63 be forwarded to Council for approval. KEY MAP Dev. 88 -133 a THE CORPORATION OF THE TOWN OF NEWCASTLE BY -LAW NUMBER 89- being a By -law to amend By -law 84 -63, the Comprehensive Zonigg By -law of the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By -law 84 -63, as amended, of the Corporation of the Town of Newcastle in order to permit the creation of one (1) additional single family residential lot. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule 114" to By -law 84 -63, as amended, is hereby further amended by changing the zone designation from "Agricultural (A)" to "Urban Residential Type one (R1)" zone as indicated on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By -law. 3. This By -law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
