THAT Report PD- 209 -89 be received; 2. THAT Application to amend the Town of Newcastle Comprehensive Zoning By -law 84 -63, as-amended, submitted by Chris Smith and Associates on behalf of the Bowmanville Valley Co- operative Homes Inc., be referred back to Staff for further processing and the preparation of a subsequent report upon resolution of all issues and receipt of all outstanding comments; and 3. THAT a copy of Council's decision be forwarded to the interested parties attached hereto. 1. BACKGROUND 1.1 Pursuant to Council's resolution of July 18, 1989 which requests the inclusion of the subject application on said agenda, said report has been prepared. /"k' ... 2 REPORT No.: PD- 209 -89 PAGE 2 1.2 In March of 1989, the Town of Newcastle Planning and Development Department Staff received an application to amend the Town of Newcastle Zoning By -law 84 -63, as amended. The application was submitted by Chris Smith & Associates on behalf of Bowmanville Valley Co- operative Homes Inc. The proposed application would change the zone category of 2.26 ha (5.58 acres) parcel of land in Part Lot 13 & 14, Concession 2, Bowmanville, from "Urban Residential Type One - Holding ((H) Rl)" and "Environmental Protection (EP)" to an appropriate zone to permit the development of 48 row townhouses and two (2), twelve (12) unit, three (3) storey apartment buildings, for a total of seventy -two (72) units. 1.3 Staff note that as of May 23, 1989, the proposal has been revised to include two (2) apartment buildings, one 12 unit and one 18 unit, the number of townhouse units has been reduced to 42. This maintains the total number of units as 72. 1.4 The site is located south of Jackman Road, east and north of the Bowmanville Creek and west of Scugog Street. Surrounding land uses include existing residential to the east, existing and proposed residential to the north, Bowmanville Creek Valley lands and estate residential to the west and proposed residential to the south. 1.5 The public meeting with respect to this application was held June 5, 1989. At that meeting Committee and Council directed the applicant to meet with the residents and Staff in order to address their concerns. 1.6 On July 31, 1989, a meeting was held in Court Room 1 with the residents, the applicant and Planning Staff. The meeting was well attended with 35 signing in. The meeting however, was not very successful, as the residents expected answers to various issues which had been raised at the Public Meeting on June 5 and were now being asked again. Inasmuch as the final grading and drainage plans were not available, the applicant was unable to provide detailed responses to enquiries regarding such matters which concerned the residents extremely. Other key concerns noted at the meeting included the upgrading of Jackman Road and the costs attributed to such works; density and parking, sidewalks and traffic on Jackman Road; emergency access of the site and the school situation. Z ...3 1.7 PAGE 3 As noted above, drainage and runoff into the Eowmanville Creek and its tributary were of key concern. Environmental issues sucn as salt increased pollutants, increased erosion, increased flows and effect on the system were continually mentioned. It was agreed that a subsequent meeting be held on September b, 1989 at 7:00 P.M. in Court Room # 1. At this time Staff has not received detailed comments from the Town of Newcastle Public Works Department and are awaiting for further comments from Central Lake Ontario Conservation Authority and Ministry of Natural Resources, based on the drainage report prepared for the subject site. Given the number of outstanding comments and issues which remain outstanding, it is recommended that the application be referred back to Staff for a subsequent report upon reciept of all outstanding comments.
