THAT Report PD- 206 -89be received; 2. THAT the rezoning application submitted by Inducon Consultants of Canada on behalf of Carholme Investments Limited requesting the removal of the "Holding (H)" symbol from the subject lands within draft Plan of Subdivision 18T- 870154, being Part of Lots 8 & 9, Broken Front Concession; former Town of Bowmanville be approved and the By -law attached hereto be forwarded to Council for approval; and 3. THAT the applicant be so advised. 1. BACKGROUND: 1.1 On October 21, 1987, the Planning and Development Department received an application submitted by Inducon Consultants on behalf of Memphis Holdings, requesting the removal of the "Holding (H)" symbol from the lands contained with Plan of Subdivision 18T- 870154. ...2 9 -7 � U REPORT NO.: PD- 205 -89 PAGE 2 -----------------------®_-----------®_--_--------------_-----_----------------- 1.2 The subject lands through Plan of Subdivision 18T -87054 received the appropriate draft approval on August 25, 1988. 2. STAFF COMMENTS: 2.1 Within the Town of Newcastle Comprehensive Zoning By -law 84 -63, Section 3.9 requires that prior to the removal of the "Holding (H)" symbol, Council is to be satisfied that the uses to be permitted will be adequately serviced, the lands to be used have adequate access, prior uses of the lands will not prevent the use of the lands for purposes intended by the By -Law, and that the necessary agreements in respect of such matters and the associated financial requirements, where required, have been executed. 2.2 The Subdivision Agreement between the Town of Newcastle and the Owners has been completed, and returned to the Owner for registration. 2.3 The Region of Durham Planning Department has confirmed that the necessary agreements are in place and would have no objection to the removal of the "Holding (H)" symbol for the majority of the site. Staff has been requested however, ensure that the lands required for a nearby interchange - shown as a Block for future development on the draft plan, is set aside for future use and remain within the (H)M1 Zone for the interim. 2.4 Staff are now in a position to recommend that the "Holding (H)" symbol be lifted; inasmuch as the conditions of draft approval, requested as conditions of the Town's approval, have been fulfilled through the Subdivision Agreement. 2.5 Staff have no objection to the application and would respectfully recommend that the attached By -Law to remove the Holding Symbol be forwarded to Council for approval. r A A D4it ...3 REPORT NO.: PD-206-EE Respectfully submitted, Franklin Wu, M^C.I.P. The "(H)M1" and 11(H)M2" zones permits existing Residential and Conservation, Forestry and Farm uses exclusive of livestock operation uses. Removing the Holding symbol from the "(H)M1" and 11(H)M2" zones would permit the development of an Eighteen (18) lot industrial development. The Council of the Corporation of the Town of Newcastle will consider the proposed amending by -law not earlier than at its General Purpose and Administration Committee meeting of September 5, 1989 and consider passing a by -law not earlier than September 11, 1989. ANY PERSON OR AGENCY REPRESENTATIVE may attend the Council meeting at which the amending by -law is considered and /or make written or verbal representation either in support of or in opposition to the proposed by -law. ADDITIONAL INFORMATION on the proposed amending by -law is available amendment is available for inspection between 8:30 a.m. and 4:30 p.m. at the Planning Department, 40 Temperance Street, BOWMANVILLE, Ontario.
