SUBJECT: STATUS REPORT - SOUTH COURTICE SERVICING FEASIBILITY STUDY
SPECIAL STUDY AREA NO. 11 - INTERIM CONTROL BY -LAW
FILES: PLN 18.1.1 AND PLN 8.6.1
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-194-89 be received;
2. THAT the by -law attached hereto to amend Interim Control By -law 88 -132 be
forwarded to Council for approval;
3. THAT Notice of the passing of the said by -law be forwarded to property owners
within the affected area and within 120 metres of the area to which the by -law
applies pursuant to Ontario Regulation 405/83 made under the Planning Act, 1983;
4. THAT a copy of the said by -law be forwarded to the Commissioner of Planning,
Region of Durham and to the Director of the Plans Administration Branch of the
Ministry of Municipal Affairs; and
5. THAT Report 194 -89 be forwarded to the Region of Durham.
1. BACKGROUND
1.1 On July 25, 1988, Council directed Staff to undertake a Planning Study to
resolve the land uses in the area identified as Special Study Area #11 in the

Durham Regional Official plan. Subsequently, on September 12, 1988
Council passed an Interim Control By-law for the Study Area to prohibit
any development or building in the area. The purpose of the Interim
Control By-law iotoensure that no development activity would
jeopardize the results of the Study.
1.2 An integral component of the Planning Study for Special Study Area #ll
is the feasibility of extending municipal services to the Study Area.
Full municipal services is considered to be fundamental to attracting
quality industry to these lands. Council authorized Staff to select a
consultant on November 7' 1989. Totten, Sims, Bobicki Associates was
subsequently selected, although their actual engagement was delayed
until funding matters were resolved on March 13, 1989.
3. SOUTH CO00TICE IR8LIMI0&I8[ SERVICING STUDY
2.1 The Preliminary Servicing Study covers a larger area than Special Study
Area #ll. The Servicing Study has been broadened and will generally
examine the servicing requirements of the area south of Courtioe. The
five areas identified are:
A. Special Study Area #ll
B. Existing Industrial Laud
C. Ontario Hydro Energy Pack Lands
D. Lands between the CPR and Blooc Street west of Tooley'o Creek
B. Lands between BIooz Street and the Couctice Urban Limit west of
Dourtice Road
2.2 A Technical Advisory Committee has been established consisting of
representatives of the Regional Works, Regional Planning, Townof
Newcastle Works and T)vuu of Newcastle Planning and Development
Departments. Two meetings of the Technical Advisory Committee have been
held, the most recent being July 12, 1989. It is anticipated that the
Preliminary Servicing Study will be completed by September.
2.3 The feasibility of providing municipal services to the Study Area will
be considered in the context of the expansion to the Courtice Urban Area

through the review of the Durham Regional official Plan. In this
regard, development options for the study area have been discussed with
the consultant, in consultation with Regional Planning Staff, and
involve a combination of industrial and residential development for Area
D and residential development only for Area E.
2.4 As a further note, the Central Lake Ontario Conservation Authority has
retained a consulting firm to develop a Master Drainage Plan for the
Robinson Creek watershed. The Watershed encompasses a substantial
proportion of the lands subject of the South Courtice Servicing
Feasibility Study, and the results of the Watershed Study will provide
important input to the Servicing Study. In order that the watershed
study is reflective of possible future run-off conditions, Town Staff
have provided the consultant with land use alternatives for the Study
Area developed in consultation with Regional Planning Staff.
3. INTERIM CONTROL BY-LAW
3.1 Interim Control By-law 88-132, covering Special Study Area No. 11 is
due to expire on July 25, 1989. Section 37(2) of the Planning Act
permits Council to extend the period of time during which an Interim
Control By-law is in effect, provided the total period of time does not
exceed two (2) years from the date of the passing of the by-law.
Accordingly, a by-law has been prepared for Council approval to amend
the Interim Control By-law to extend its effective period to July 25,
1990.

TAKE NOTICE that the Council of the Corporation of the Town of Newcastle
passed By -law No. on the 24th day of July, 1989, under Section 37
of the Planning Act, 1983.
AND TAKE NOTICE that pursuant to Section 37(4) of the Planning Act, 1983, any
person or agency may appeal to the Ontario Municipal Board in respect of the
by-law by filing with the Clerk of the Corporation of the Town of Newcastle
not later than the 22nd day of September, 1989, a Notice of Appeal setting out
the objection to the by-law and the reasons in support of the objection.
EXPLANATION AS TO PURPOSE AND EFFECT OF
INTERIM CONTROL BY-LAW NO. 89-
The Purpose and Effect of this By-law is to extend the period of time during
which Interim Control By-law 88-132 will be in effect. Said By-law will now
expire on July 25, 1990.

being a By -law of the Corporation of the Town of Newcastle to amend By -law
88 -132.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
necessary to extend the effective period of By -law 88 -132, being an Interim
Control By -law for the Area generally bounded by Darlington Generating Station,
Darlington Provincial Park, Highway No. 401, and Lake Ontario;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of
Newcastle enacts as follows;
1. THAT By -law 88 -132 be amended by deleting the date "July 25, 1989" from
Paragraph 4, Line 2 and inserting thereto the date "July 25, 1990 ".
2. This By -law shall come into effect on the date of passing hereof.

being an Interim Control By -law passed pursuant to Section 37 of the
Planning Act, 1983.
WHEREAS the Council of the Corporation of the Town of Newcastle, at its
meeting held on July 25, 1988, directed a Study be undertaken for the Area
generally bounded by Darlington Generating Station, Darlington Provincial
Park, Highway No. 401, and Lake Ontario; and
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
necessary to prohibit any further development and building activities in
the said area;
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
enacts as follows:
1. Notwithstanding the provisions of Comprehensive Zoning By -law
84 -63, the area identified as "Land Affected by By -law" as per the
attached Schedule "X" shall be subject to the provisions of this Interim
Control By -law. No person shall within the "Land-Affected by By -law" use
any land, building or structure for any purpose other than for a purpose
for which the land, building or structure was lawfully used on September
12, 1988.
2. Notwithstanding Section 1 of this By -law, an addition to the
building located on that portion of the.land to which this by -law applies

which was used.for auto auction purposes on September 12, 1988 and is zoned
} "M -2" under By -law 84 -63, may be erected and used for auto auction purposes
provided the "floor area ", as defined in By- law"84 -63, which is contained
in the addition.does not exceed twenty percent (208) of the floor area
contained in the aforesaid building.
3. Schedule "X'' attached hereto shall form part of this By -law.
4. This By -law shall come into effect on the date of passing hereof,
and shall remain in effect until July 25, 1989.
