OF DARLINGTON OUR FILE: DEV 87-63 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-183-89 be received; 2. THAT as Council's resolution (#D-379-89) approved the rezoning application submitted by Gerald and Ethel BnIaou, the by-law attached hereto be forwarded to Council for approval.; and 3. THAT the applicant be so advised. REPORT 1.1 On May 15, 1989, Staff presented the General Purpose and Administration Committee with an Addendum Report to PD-34-89. This report recommended denial of the application by Gerald and Ethel Bmlaou to rezone o 0.38 ha parcel of land in Part Lot 18, Concession 5' former Township of Darlington to allow the development of an additional lot. - L J � J� '� � / REPORT N0.; PD-183-89 PAGE 2 _______________________________________________________________________________ 1.2 At a regular meeting of Council no June 26^ 1989, Council by ceo"Iutlou approved the application to remooe the 0.38 ha parcel. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By -law 84 -63, as amended, of the Corporation of the Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 9.3, "Special Exceptions - Residential Hamlet (RH)" zone is hereby amended by adding thereto, the following new "Special Exception 9.3.13" as follows: 119.3.13 RESIDENTIAL HAMLET EXCEPTION (RH -13) ZONE Notwithstanding Section 9.2, those lands zoned "RH -13" on the . Schedules to this by -law shall be subject to the following zone regulation: .a) Lot Area (minimum) .1500 square metres" 2. Schedule 117" to By -law 84 -63, as amended, is hereby further amended by changing to "RH -13" -the zone designation of the lands indicated as "Zone Change to RH- 1311-as indicated on the attached Schedule "A" hereto. 3. Schedule "A" attached hereto shall form part of this By -law. 4. This By =law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act..
