MARY'S CEMENT CORP. PART LOT 11 - 17, B.F.C. FORMER TOWNSHIP OF DARLINGTON FILE: OPA 89-68/D/Ni DEV 89-74 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-182-89 be received; and 2. THAT the application for Official Plan Amendment and Zoning By-law Amendment submitted by Mr. J. 0. Down on behalf of St. Mary's Cement Corporation to recognize the existing water lot docking facility and permit an expansion to the docking facility be referred back to Staff for a subsequent report pending receipt of all agency comments; and 3. THAT the Region of Durham be so advised; and 4. THAT those names attached hereto be so advised. 1. APPLICATION: 1.1 On June 8, 1989 the Planning and Development Departemnt received an application to amend By-law 84-63, submitted by Mr. J. 0. Down on behalf of St. Mary's Company, a Division of St. Mary's Cement Corporation. Subsequently, on June 22, 1989 the Town was advised by the Region of Durham of an application submitted by St. Mary's Cement Company, to amend the Durham Region official Plan. � 4 14110011IN0110AW 9 1.2 The amendments are two part. Firstly, the amendment to the Official Plan and Zoning By-law would recognize the existing water docking facility, which extends 650 metres into Lake Ontario and was constructed by St. Mary's between 1974 and 1979, on a 32.4 hectare Crown waterlot. Secondly, the amendments would permit an expansion to the existing dock into the waterlot of Lake Ontario west of and abutting a waterlot previously acquired supporting the existing dock. The proposed lot is 425 metres wide and approximately 800 metres deep comprising of 32 hectares. It is intended that approximately 24 hectares of usable dock area will be created. 2. BACKGROUND: 2.1 Recently, St. Mary's Cement Corporation has announced a $160,000,000.00 expansion to the Bowmanville plant, to increase production of cement from 2,000 to 5,000 tonnes per day. To facilitate this, St. Mary's also wishes to expand its port facility by widening the existing dock. This would accomodate the simultaneous handling of two maximum size seaway bulk cargo carriers and provide additional storage for cement, slag, coal, etc. 2.2 In 1987 St. Mary's Cement Corporation had purchased the existing waterlot as a minor disposition of Crown resources by order-in-council. In 1987 St. Mary's was also given a 5 year option to purchase the waterlot proposed for expansion. Accordingly, in March 1989, St. Mary's Cement Corporation made an application to acquire a Crown waterlot to the Ministry of Natural Resources. The application is under exemption order Ministry of Natural Resources 26/4 guided under the provisions of the Environment Assessment Act. The lakefill and wharf construction are authorized and monitored by Ministy of Environment and Ministry of Natural Resources. A certificate of approval is issued under an Environmental Assessment Act. 3. PUBLIC NOTICE AND SUBMISSIONS: 3.1 Pursuant to Council's resolution of July 26, 1982 and the requirements ...3 REPORT NO. : PD-1 82-89 PAGE 3 of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 3.2 As a result of the Public Meeting Notices, Staff have received one written letter of objection, opposing the expansion of the existing dock from a resident in the area. The letter points out a number of problems resulting from the existing dock, such as increased noise pollution from boats blowing horns and blasting, increased dust, increase in oil slicks in the water and shoreline and the increase in marine life that is usually washed up on the shore. 4. AGENCY COMMENTS: 4.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following departments /agencies in providing comments, offered no objection to the application as filed: - Ontario Hydro 4.2 The Town of Newcastle Fire Department offered no objection however requires the dock to support Fire Department equipment in the case, as has happened a fire should break out on board a supply ship. In addition a drafting pipe, to allow for the drafting of water from the lake to supply Fire Department vehicles should be considered. 4.3 Staff would note that comments are still outstanding from: - Town of Newcastle Public Works - Central Lake Ontario Conservation Authority - Regional Works Department - Ministry of Natural Resourses - Ministry of Environment ...4 1 iA0 J`tCvi 5. STAFF COMMENTS: W N I1 5.1 In June 1989, Planning Staff had met with representatives of St. Mary's Cement Company. The meeting precipitated an application for building permit to construct new shipping silos on the existing dock. Since the land in question is not recognized in the Official Plan or Zoning By -law, Staff was not prepared to issue a building permit. In view of St. Mary's urgency to begin construction of the silos before the onset of cold weather, Staff have had examined the possibility of the approval of a designation and zoning on the existing dock with the option of deferring any further recommendation on the proposed expansion. However in view of the outstanding agency comments and the letter of objection from the area resident on the West Beach Road, Staff would require a further examination of the possible impacts to the environment and community. 5.2 In addition to the foregoing, the applicants, through an Environmental Assessment is required to do a number of studies to address impacts on marine life, air and noise pollution etc. Staff must await the outcome of these studies prior to provide a recommendation. 6. RECOMMENDATION: 6.1 In consideration of the above, Staff would respectfully recommend that the applications be referred back to Staff for a subsequent Report pending receipt of all outstanding comments. This report was prepared for the purpose of facilitating a Public Meeting in accordance with the Planning Act requirement.
