BOBBIE TIMS MODIFICATION TO HAMLET OF NEWTONVILLE SECONDARY PLAN FILE: OP 3.10 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-170-89 be received; 2. THAT the Ministry of Municipal Affairs be advised that the Town of Newcastle does not support a modification to the Hamlet of Newtonville Secondary Plan to include the property of Mr. and Mrs. Dave Tims; and 3. THAT the Ministry of Municipal Affairs and the Region of Durham be forwarded a copy of ReportV�, 1. REQUEST FOR MODIFICATION 1.1 Mr. and Mrs. Dave Tims own a 2.25 acre property located on the east side of Ovens Road, immediately north of Highway #401, in Lot 10, Concession 1, in the former Township of Clarke. The subject lands, located immediately adjacent to the Newtonville Hamlet boundary, are indicated on Attachment #1. V 1} ...2 REPORT NO.: PD-170-89 --------------------------------- ---------------------------------------------- 1.2 The Hamlet Secondary Plan of Newtonville was adopted with the Hamlet Plan provisions of the Town of Newcastle Official Plan by Regional Council on January 11, 1989. The Plan is presently before the Ministry of Municipal Affairs for review. Mrs. Bobbie Tims wrote to the Ministry on April 28, 1989, requesting that the Secondary Plan be modified to include their property within the Hamlet. This would enable the Tims to connect to the municipal water supply system. In responding to Mrs. Tims' request, Mr. Brian Nixon of the Ministry of Municipal Affairs requested the comments of the Region and the Town (Attachment #2). 2. BACKGROUND 2.1 A Development Plan for the Hamlet of Newtonville was initially prepared for Newtonville in 1979 on the basis of minor infilling and additions to the Hamlet. The Hamlet Development Plan was subsequently revised in 1981 to indicate the development concept for Newtonville on the basis of being a "hamlet for growth" with a total of approximately 300 units. The revised Development Plan was based on private services and included the Tims' property within the Hamlet boundary. It was forwarded to the Region of Durham for comment and, at that time, the Region did not endorse the Plan. Furthermore, the Durham Regional official Plan was not amended to recognize Newtonville as a "hamlet for growth" due to the soil pollution and groundwater problems existing in the hamlet. 2.2 The soil and groundwater contamination problems were subsequently addressed in the studies undertaken by MacLaren Engineers. The resolution of this issue led to the recognition of Newtonville as a "hamlet for growth" with municipal water services. ...3 599 24 2.3 On June 22, 1987, Town Council resolved the following: "That Council utilize the Hamlet Development Plan for Newtonville as forwarded to the Region of Durham on April 29, 1981, as the basis for a possible amendment to the Durham Regional Official Plan and the Town of Newcastle Official Plan". In the process of resolving the land uses and hamlet boundaries to be incorporated into the Secondary Plan for Newtonville, a number of modifications to both the land use schedules and the policies were undertaken. The Secondary Plan, as adopted by Regional Council on January 11, 1989, excluded the Tims' property from the Hamlet. 2.4 The basis for this particular modification was the decision to extend municipal water services to Newtonville and the concurrent com-nittment to extend water services to lands within the hamlet boundary. The Tims' property is isolated from existing and proposed development areas of the hamlet and the Region does not consider it economically feasible to extend water services for one residence. 2.5 The Regional Works Department reviewed the modification request by Mrs. Tims and noted that this property was not included in the water quality study area. The Regional Works Department further noted that the problem as reported by Mr. and Mrs. Tims seemed to be a matter of water quantity rather than water quality. The Region plans to extend water services approximately 250 metres south from Highway #2. To service the Tims' property, the watermain would have to be extended an additional 430 metres to service only one residence. COMMENT IWO-IM21 Staff have reviewed this matter with Regional Staff and concur that the extension of municipal water services is not warranted on the basis of the available information and in light of the associated costs. It is recommended that the modification request submitted by Mrs. Bobbie Tims not be supported. DIANA JARDINE Director of Plans Administration Branch RE: MODIFICATION OF HAMLET OF NEWTONVILLE SECONDARY PLAN SCHEDULE 9 - 6 Dear Mrs. Jardine: As a resident of the Town of Newcastle, Hamlet of Newtonville, I am greatly concerned on the proposed hamlet boundries in regards to the township water lines to be put in in the near future. My family has only been a resident of Newtonville since September, 1988 when we took possession of the property, and we are situated on the last property adjacent to the 401 on Ovens Road formally Reid Road as shown on the attached map. We are in dire need of water. Since September we have run completly out of water a total of five (5) times, which I can account for as I still have the receipts from the water truck which was needed to drop a load of water each time into our well in order to replenish it. When we moved in, the water was undrinkable as the fecus level according to the Ministry that tests well water found it far exceeding levels for human comsumption. This tested high for six (6) weeks until we could actually drink our own water. I am greatly concerned as I have a three (3) year old and I am expecting our second child in early August of this year. My greatest fear is if our region does not get enough water in the near future, our property will run out of water again. Each time you get a load of water the water must be tested for bacteria count again which could put us in the same situation we were in before. When the original public notice was put in the local paper, our property was included which didn't leave me very much concerned. Since the public meeting was held a new revised map has been submitted and our property has been excluded. Please review these matters and take them under consideration.
