HomeMy WebLinkAboutPD-167-89rffavnv' �I` ,- ­'111" -,,, TOWN OF NEWCASTLE MEETING: General Purpose and Administration Committee DATE: Monday, July 3, 1989 RffMT #: PD-167-89 FILE #: LD 81/80 File # 7-/ Res. # By-Law # SUBJECT: VAN DORP - 0.3 METRE RESERVE PART OF LOTS 15 AND 16, CONC. 7, FORMER TOWNSHIP OF DARLINGTON REQUEST FOR REMOVAL OF 0.3 METRE RESERVE RECOMMENDATIONS: it is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD- 167 -89 be received; 2. THAT the request submitted by Mr. and Mrs. Van Dorp to permit the reconveyance of the 0.3 metre reserve, descirbed as Part 10, 1OR-1118, be DENIED; and 3. That Mr. and Mrs. Van Dorp be advised of Council's actions. 1. BACKGROUND 1.1 By correspondence, dated May 16, 1989, relating to Land Division LD 81/80, Mr. and Mrs. Van Dorp requested the lifting of a 0.3 metre reserve along the most southerly frontage of their lands (see attached sketch). 1.2 The property in question was the subject of a Land Division application (LD 81/80) submitted by the former owners, Ralph and Judith Hill. This application was approved by the Land Division Committee on February 25, 1980, as a severance of a 60 ha (148 acre) parcel for the purpose of 2 599 05 D890DT 0O.; pD-167-89 WK070M "farm consolidation" and the retention of a 4 ha (lO acre) parcel containing a residence and farm buildings. The approval was conditional upon m one foot (0.3 metre) reserve being dedicated to the Regional Municipality ot Durham along Regional Road No. 57, and the Town of Newcastle along the remaining frontages of the subject lands. The severance was completed and the severed parcel was subsequently conveyed to the neighbouring farmer, Mc. Van Dorp. 2. LOCATION 2.1 The subject lands are located within part of Imta 15 and 16, Concession 7, former Township of Darlington, having frontage onto Regional Road 0o. 57, the 7th Concession Road and Lettner Road. 3. OFFICIAL PLAN POLICIES 3.1 The subject lands are located within the Permanent Agricultural Reserve designation. Within the Town's Zoning By-law 84-63, the lands are approximately zoned "Agricultural Exception (&-l)» and "Environmental Protection (EP)x. Laud Division Committee application 0o. LD 81/80 was approved in consideration of the policies and provisions of the Regional Official Plan. 4. STAFF COMMENTS 4.1 The Laud Division Committee, in considering and approving Q} 81/80' in essence, by requiring the dedication of the 0.3 metre reserve, provided additional notice to the owners, as well a any subsequent owners, by its existence, that a building permit was not available. The approval as given was in consideration of the policies and provisions of the Regional official Plan, and accordingly was conditional upon the granting to the Region and the Town of the 0.3 metre reserves. ...3 rOO [\� J// uV REPORT NO.: PD-167-89 4.2 Staff would note for the Committees' information that Regional Council, in considering a similar request for the lifting of the 0.3 metre reserve along Regional Road 0o. 57, endorsed the Regional Commissioner of 9Iaooiug'o Report 0o. 88l9I' that the request to lift the 0.3 metre reserve be denied. 4.3 It is Staff's opinion that there is no planning justification to remove the 0.3 metre reserve, and accordingly can not support Mr. and Mrs. Van Dorps request.
